PETALING JAYA: The Malaysian Communications and Multimedia Commission (MCMC) has issued instruction notices to four telcos for misleading members of the public with their Internet data promos.

In a May 20 statement, MCMC said the notices were issued to Celcom, Maxis, Tune Talk and Webe, in accordance with Section 127 of the Communications and Multimedia Act (CMA) 1998, for failing to comply with advertising-related provisions as stated in the General Consumer Code of Practice for the communications and multimedia industry.

All four service providers were also instructed to rectify the promotional materials with misleading information, and to take steps to clarify any confusion that may have resulted thereof.

Based on the results of a monitoring exercise, the commission said it has also found that there are still some service providers that have released confusing promotional offers without clearly stating the terms and conditions, including on its Fair Usage Policy (FUP).

MCMC said it should be noted that FUP is an approach to provide equal experience to all users and to curb excessive usage that could disrupt the experience of others.

Service providers that fail to comply can be fined under Section 242 of the CMA 1998, which stipulates a fine of no more than RM100,000 or two years imprisonment, or both.

MCMC said it is taking action to protect consumer interest following a newspaper report on telcos promising unlimited Internet data experience without detailing how some users may experience reduced speed after exceeding a certain usage quota.

The commission is also urging users to fully understand all information behind any plans that are being offered before deciding to purchase or subscribe. They are also reminded to subscribe to a plan based on their own usage and needs.

The same advice is also extended to parents who are looking to conduct home-based learning for their children.

In mid-2020, many affordable 4G phone plans came on the market and advertised/promoted as unlimited-data and/or unlimited/high speed but did not also state publicly that there were monthly FUP data limits(eg 50GB) and video-streaming limits(eg limited to SD/480p/1Mbps). These limits were often "hidden" in the celcos' T&C or their social media accounts or not available at all, eg Webe or TM Unifi Mobile prepaid Bebas Weekly/Monthly 4G phone plans are limited to 10Mbps.

Back to like 8 or 10 years ago, we had reported maxis was abusing FUP term, retrieved all the unlimited plan biz68, biz99, legacy 99... by force.
And if i am not wrong, the unlimited prepaid with FUP was started by hotlink as well.
That time MCMC agreed with maxis but why now change of mind?
