i order something from taobao,

i pay the shipping company and they help me pay the china seller,

so that he can give me a malaysia invoice with his company name,

he charge me 2% service fee.

they charge me shipping per cubic meter with custom tax included.

i sell this item in malaysia.

i would like to know is this legal or is this considered grey area?

It depends on the total amount, frequency, and your targeted customer. If you are selling a huge amount of goods, at frequent intervals, to businesses, then of course you have to do it the proper way by registering yourself or a business, get the necessary license and permits, pay income tax, to conduct this business.

If it is just a one off or infrequent thing to individuals, then I'd bother too much. If it is to a business entity, then you have to see whether they need a proper invoice for tax purposes.

It's legit but you have to consider warranty/invoice issue (such as registration to SSM, tax bla bla)

Imagine you buy from A sell to B, if warranty issue arise B will claim from you and you claim from A

Why dont you straight away become Taobao agent? Straight forward

Reminds me of a story of potter who asked the gods for his pots to be unbreakable.
