Would like to seek advice from sifus here. Currently, I have just purchased a sub sale LEASEHOLD strata title property and am in the midst of all the legal documentation. I have already signed the SPA and loan documentation and all.
however, I aknowledge that according to the SPA, the agreement only enforce once the precedent condition (concern from developer for transfer ownership & maintenance fee clearance) settle. the SPA was signed on 20th July'20, but till now they keep telling me the above process still on going. yet, I get to know from my lawyer the whole process may take up to 6months.
early stage before I engage the lawyer, they confidently told me that the max duration for the transfer will only be up to 4months (1+3).
my question is, will all the document still valid if the process drag up to 6months? the SPA stated 1 month for developer concern, if required will need extra 1 month upon both purchaser and vendor agreement. once everything clear, only the SPA run and the loan shall be fully disburse in 3 months time.
is it norm leasehold strata title property consent will take such a long time?
will it not beneficial to me if the process taking longer? as my unit is partly furnish, the things may spoil or not functioning down the 6months waiting period. do i have right to get the vendor to repair it if any?
how to make sure my lawyer is doing their job as they keep on asking me to wait only. will them refund me the lawyer fee if developer consent fail or vendor decided not to continue the sale after the lead time?
