 Water leaking from upper unit, need advice pls, The Hxmilton, Wangsamaju

Hi guys,

I just collected my house key on last year november, but in my bathroom happened 2 times water leaking issue from upper unit... on February and July. bangwall.gif The first time I reported the defect on February, the defect team come check and fixed it. But this second time on July, it getting worst especially after someone moved in.

I try to ask the management team to help me contact the owner upstair. (The china tenants upstair didnt open door for me, so i have no choice to beg MO to contact the owner for me) The team keep giving me excuses and ignoring my requests. Thankfully I managed to get the owner number from their appointed agent that helped them rent the house.

Management team + main con + developer is trying to fix the water leaking issue from my unit, and not letting upper floor owner know about it. They said they only can use "PU Injection" as the solution, and they won't do anything from upper floor. But common sense, the water flow from top... how long the PU gonna last? They just want to fix this issue as long as it won't leak within the 2 years warranty.

The main con and someone from developer side came to my house, and told me that the leak is maybe not caused by the concrete, maybe the pipe. (Obviously the concrete is wet! =.=) Ok fine, then he said he will get SPECIALIST next day to INVESTIGATE/CHECKING.

The next day, specialist came along with the tools and equipments. I stopped them and said "the person yesterday told me you guys just come to CHECK, not FIX".... I can't believe that the developer is trying to force me to use their method without my agreement. Even the so called "specialist" can't even tell me what kind of PU product or method they are using. I asked MO, they keep saying "we use very expensive PU, not those cheap cheap one" (I'm speechless...) ranting.gif

I contacted the owner on upper floor (investor, just want to rent out the unit), but they seem like didn't even bother much to help me to complain about his unit waterproofing issue. icon_question.gif

Can anyone here share with me what should i do? Me and my family is strongly disagree to use PU injection, if after few years later...the water leaking happen again, who gonna pay the cost to repair? upper unit or my unit?

for sure the permanent solution is hack the upper floor bathroom tiles & redo the waterproofing. any other method like fixing from ur ceiling side won't last long

Yess... that feeling is like shxt... new condo but have so many problem (not only inside the house, but facilities too), and the management team and developer is so so irresponsible. bangwall.gif

if I'm not mistaken. nowadays newly developed housing unit got 2yrs warranty. bank will hold certain amount of ur loan (10% if I'm not mistaken). after 2yrs no complaint from u for the house defect not being repaired then bank will release that balance to the developer. my friend said u can inform developer if they didn't fix it properly, u will file a complaint to the bank so that balance will be hold by bank until they fix it. not sure though. maybe /k who expert can give more correct info.

I heard about it too, but i have no idea how to start... write formal letter to lawyer? hope someone here can advice me on this...

now, got new additional rulling on Akta Had Masa 1953 which cover defect up to 15 years...you can claim damage to developer in 15 year period after incident happen...

example:

buy house 2005, 2018 found crack, expert said 2010 crack happen, can claim 3 years onward from 2018

buy house 2000, 2020 found crack, expert said crack happen 2004, cannot claim as incident past 15 years coverage.

but this need to bring the matter to the court for claim...

What can i do if the irresponsible owner upstair ask me use PU injection?
