On the 29 july i cod with irenelim for a used nokia 7390 at kelana jaya and he promised me a two months warranty.. The handset is working fine at the moment but the charger is faulty when i tried charging it on monday, now i'm using the charger of my other phone..

Our negotiations on how to replace the charger broke down on the phone, so i'm posting here to provide my choices on how to resolve this matter. i gave him 3 choices:

1. Exchange for a new charger by dealing face to face in bandar utama, which is near where i stay.. I chose this location instead of kelana jaya because this defect was not any fault of mine, so the seller gotta make it up a little.

2. Post me a new charger.

3. Refund me rm20 for me to get a new charger.. My friend got one from sg wang for rm15, so i think that's the general selling price, add in rm5 for my time and transportation cost to get the replacement.

I think my offers are quite reasonable, seller please respond immediately, thank you! No flames please, i just wanna settle this problem asap..

What you mean by negotiations broke down on the phone? Dispute Corner is for you guys to post your dispute after both of you have tried your very best but still end up cant get meet a solution. This place certainly not for you to simply post here without even trying your very best to find a solution with the other party.

I've tried, but seller replied that my offers are unreasonable.

PM him the existence of this thread, meanwhile you can highlight your proposal together with some reasonable reason to support your proposal.

Negotiation did not really broke down, buyer refuse to listen to me saying i give excuses.

1)We met at location A, Buyer wants to claim warranty from location B ... Nearer to his house, clearly not MINE . Defects on the charger, i wanna claim he doesn't wan to !!!

2)Not willing to post ? Dude i suggested that method !!! not u ... i said my charger was new can claim warranty dun so angry first but u refuse. Then u said u post to me first la then only i post it back (the spoil charger) to u and somemore U BEAR the postage fees. I only ask one question ? Which seller usually will bear postage fees ? Not viking, not cwtan, not clarren surely not me. Buyer was so rude b4 i can even talk about postage fees he then say "u pay ah".

3)He requested rm20 from me. I said charger cost only 10 go lelong search lowest was rm5. He then say 'what the sh*t la need postage and this and that not my problem wont so cheap wan, think i wan cheat u few bucks'. Say buy at sg wang its rm15, pay my traveling expenses and time expenses (not really my problem: he stays BU go sg wang buy, somemore says his fren claim its rm15). I offer rm10 as i willing to bank in to him without claiming back the spoil charger quite reasonable ?

Buyer is exceptionally rude ... i took the trouble to call instead of msg, he then say 'ask u pay rm20 u pay la, i hate ppl who negotiate like that with me, only rm20 wat ... If u dun pay me i report to lyn. This clearly sounds like a threat to me not negotiation !!! so u ask me pay i pay is it ? somemore say i bully u ? Ask him u think u some hot shot ... reply: YES I AM U PAY ME OK ...

Which seller/shop claims warranty without even seeing & testing the faulty item ?

Pls do read my terms & conditions ... acc NO warranty same for any sellers out there rite ? But i still took the initiative to reply and called u !!! I still intend to warranty acc for certain cases as item is cheap and easily obtain by me.

Said no after sales argument, after sales service should meet my time/location.

I gave u two months warranty but u try take advantage ... so u mean i warranty u from bottom to toe ?

Bro u its not about money man its about your attitude/manners/threats towards me.

Eh TS u don`t be so overreacting over a small matter as a charger la...

Irene is kind enough to refund u 10 bucks over the spoilt charger is already very nice d, afaik, a standard charger, not counting those high quality one cost only 10 bucks

wow...if that's what really happened, i'd advice the seller to just forget about him.

TS, i would advice u to accept the offer of a RM10 refund or just post back the charger to the seller and he'll send u a new one. just to be fair, each of u will bear the postage fee for sending the charger to one another. (to be honest, the buyer should bear all postage charges, but this compromise should help bring this problem to an end).

Why should the buyer bear the postage fee? The charger was faulty from the start, i cant even use it from the start.. When we cod i only tested the phone, there's no socket for me to test the charger..

And why should i just accept rm10 when the charger cost more than that? If there's a charger seller going around the neighbourhood selling chargers like the ice cream man for rm10, i'll gladly accept the rm10 given..

But then my fren bought one for rm15, and i added rm5 to cover cost for my time and transportation, even going to the pasar malam need petrol right?? Therefore i think rm20 is fair enough, which is why i'm pissed off when seller try to reduce it to only rm10..

And wat is the problem with the seller that i'm taking advantage of his warranty coverage? The charger is clearly faulty as i couldn't use it the first time, it's not like it broke down after a week or a month..

Yes i can be very verbal during telephone conversation giving out my arguments, but i never once used the four f*** letter word unlike the seller, and i had to remind him to stop using it.

Yes i can post back the faulty charger if seller wanna warranty it, but seller has to post me a new charger 1st, but i think the seller have to bear all the postage charge, because this charger defect is clearly no fault of mine.. Other buyer have to bear postage charge because they use the item for awhile and it spoils, but this was clearly faulty in the first place.. And i'm gracious enough to spend time to go to the post office to post it,,

Overreacting or not is not for you to judge, if you could be generous enough to throw in 20 bucks i'll gladly close this thread.. I'm just exercising my right as a buyer..

I think the postage shd be share share among u two. Try imagine u brought a h/p from sg wang and found the charger is faulty after that, u also need to drive back and claim for warranty. Will the shop owner pay u compensate?

The seller is kind enuf to negotiate but somebody wanted to take advantage on him....

u said that the defect was not caused by you....can u prove it? clearly not. the seller might also say that he tested the charger b4 handing it over to u..and can he prove that? i bet neither could he. which brings me to the highlighted comment...why does he have to send u a new charger first? IMHO, the seller has the right the inspect the faulty charger b4 replacing it for u, regardless of whether it's under warranty or not. so, this all boils down to the issue of trust. clearly u dun trust him to send u a new one once he receives ur supposedly faulty charger...and yet u expect him to take ur word that u'll send back the faulty charger once u received ur replacement? doh.gif as for postage charges, the best way is to split it between the both of u. i'm sure when u send ur other stuff in for warranty claims, the shop will not compensate ur expenses. (e.g. parking, petrol, etc.)

clearly there r only 2 options for u:

1) as for the RM20 refund u demanded, it's only fair if u both compromise and meet in the middle i.e. RM15. no point in arguing about the market price of the charger as it'll definitely differ depending on quality and location.

2) you send back the faulty charger to the seller(u bear postage). seller confirms the fault. seller sends u new charger (he bears postage). shouldn't take longer than 4 days to make it happen.

Dude, puhleez, do i have to take advantage just for 20 bucks?? If i wanna, i could claim that the battery is failling and etc etc, should get more money.. I'm not being unreasonable here and demanding a original charger.

I'll take option 1 then, rm15 in the middle.. Since there's no proof who cause the charger to be faulty, there's also no guarantee that the new charger he is sending is 100% working too, and i'd be wasting my postage money again.. I believe seller has my mbb acc, deposit the money, sms or pm me and i'll close this thread..

What i can see here is, irenelim is responsible enuf. I know of course u wont be happy if the charger is not working, but for a rm5 charger, seller willing to compensate rm10 for u.. Thts more than reasonable bro.. If meet up back at kelana jaya or sth also quite reasonable di ma..

My advise is.. Don't take too much without giving. U have ur rights as a buyer, irenelim has his as a seller. Imagine if he ignores u here, what can u do? All of us here knows him as a good seller, small things like this wont damage his reputation, it will only make u a very unreasonable buyer..

Wow, if the seller is good, the buyer claims for small things, then the buyer is unreasonable.. Nice theory u got there..

And which shop sells charger for rm5, kindly let me know.. I believe that's the price you get when you buy in bulk of a few hundred, but problem is i only need one.

Now there just because you sold many things doesn't make you a great seller, and you have no idea whether i've been a seller before or not, so don't go around making your own assumptions..

To be frank, better quality compatible chargers can range from RM15 to RM25. Those costing a few bucks will not last long and will be spoilt after a few months later. I feel that the buyer should be compensated with a decent, reliable and usable charger for his phone.
