Hi guys. Just want to ask for opinions.

Anyone familiar with labour law feel free to comment ya...

Story is like this... Right after MCO, co said staff all take pay cut to help the company. So April pay is 80% . Now, i think the company seeing the industry is going to take about 1-2years to gain traction again, marked 4 pax to leave the company, given 2 mth notice. so considered til 15 July as official letter will be out this Friday.

Is there anything that can be done to recoup that 20%salary x 3 mths (Apr/May/June)? Coz to me it feels like co planned it. reduce salary, staff agree, then fire.

At average of 6.5-7k salary, its easily rm4200 there, and it wont be easy to look for job in this current economy...

Capture on written evidences. Ready to bring to labor court. This is one way and you might never get job again with them. You want to play nice or court ?

TS can google retrenchment requirements
And as 2 members mention, bring to labour court.
Company can retrench staff in hard times but should be fairly compensated.

All the best.

TS, if they compensate you fairly, you might want to think twice to go to labour court.

Don't burn bridge. You will never know if you will run into them in the future. Especially if same industry.

Only go to labour court if they retrench unjustly and with short notice.
For management to make such a decision, they most likely have also consulted various parties on how to execute.

First thing to do, just go talk to the HR. Legal options are always available, but you don't need to burn those bridges until other recourse have been taken.

Labour Court will have their hands full this time which may result cases to delay. Get your justifiable compensation and move on.

Talk nicely first. Told them you agree with the pay cut is expect no retrenchment. Since retrenchment is unavoidable, expect them to compensate with full salary. If can't get back full 20% maybe can nego for 10% which is not too bad.
