Mosley agrees to re-open McLaren spy case
FIA Court of Appeal to hear team arguments

Following the written request of Ferrari's national sanctioning organisation, the Automobile Club d'Italia (ACI), Mosley said it was right to further investigate the case because Ferrari had not been allowed to present evidence in last Thursday's hearing of the World Motor Sport Council.

McLaren in Paris was found to be in breach of clause 151c of the International Sporting Code but was not penalised, which in ACI president Luigi Macaluso's view is 'quite difficult to justify'.

He claimed that 'several top team representatives' of McLaren knew about chief designer Mike Coughlan's espionage activities over several months, but that Ferrari had been unable to counter McLaren's defence that no employee besides Coughlan knew about the 780-pages of secret information.

In a written reply to Macaluso, who after the Paris hearing had also verbally questioned the FIA's decision, Mosley said probing the matter further was also important for 'public confidence in the outcome'.

He wrote: "I will send this matter to the FIA Court of Appeal ... with a request that the Court hear both Ferrari and McLaren and any other Championship competitor who so requests and determine whether the decision of the WMSC was appropriate and, if not substitute such other decision as may be just."

Ferrari press on with legal action
Statement with regards to the spy scandal

Today, in Maranello, the Ferrari S.p.A. Board of Directors met to deliberate about the legal actions taken in the last weeks by the Gestione Sportiva.

The Board has ratified what happened until now, which is the action taken against Nigel Stepney over the fact of the powder found around the refuelling aperture on the F1 cars during the Monaco Grand Prix tests.

The submission of another legal action against Stepney concerning the theft of technical information, the civil action presented to The High Court of London against Mike Coughlan, chief designer of Vodafone McLaren Mercedes, and his wife, concerning the theft of the aforementioned documents.

The Board took note of the FIA World Council's decision of 26th of July and of today's decision from the FIA President, Max Mosley, to refer this matter to a hearing of the FIA Court of Appeal, where Ferrari, as the injured party of the incident, will be accorded all the rights to which they are entitled in a trial, which was not the case at the World Council meeting.

The Board gives its full authority to the Board of Directors' President, to the CEO, and to the Managing Director to initiate and continue any necessary legal action, in the name of the Company, in addiction to those legal actions already underway in every legal, civil, criminal, administrative, sporting jurisdiction be it, in Italy or abroad.

Whilst this is both disappointing and time-consuming, McLaren is confident that the FIA International Court of Appeal will also exonerate McLaren and we will in the meanwhile continue to focus on our current World Championship programme."

i think yesterday controversial pole by alonso + punishment by the stewards = bad name for mclaren

surely this will have some impact on the spying court case

i think ron should focus more on solving the on going fire between his drivers than keep blasting ferrari of cheating..... bla bla bla

International Court of Appeal date set
ICA keen to show transparency in hearing

As we reported this morning, the International Court of Appeal (ICA) will meet in the second week of September to determine the fate of the McLaren Mercedes team. The following is a statement from the FIA.

"The International Court of Appeal will meet in Paris on Thursday September 13, 2007 to hear a referral by the President of the FIA concerning a decision of the World Motor Sport Council regarding a breach by the Vodafone McLaren Mercedes team of Article 151© of the International Sporting Code.

"The referral was made by the FIA President under the terms of Article 23(1) of the FIA Statutes and Article 1 of the ICA Rules and Procedure.

"In the interests of transparency the hearing will be open to members of the press and details of the accreditation procedure will be published closer to the time.

"All of the teams competing in the 2007 FIA Formula One World Championship have been given the opportunity to make written submissions to the ICA and have been invited to attend the hearing to supplement their submissions with oral presentations."
