Sesetengah orang mungkin menganggap wang RM1,600 yang dimasukkan ke akaun oleh pihak tidak dikenali sebagai “rezeki terpijak”.

Bagaimanapun, bagi Wendy Lim, pelajar sarjana kerja-kerja sosial di Australia, ia bertentangan dengan nilai moral yang dipegangnya.

Oleh itu, kata Wendy, 26, dia memulangkan kembali kepada tuannya yang bersusah payah cuba menjejaknya selama enam bulan.
“Saya merasa puas dan lega kerana misi memulangkan wang kepada pemilik asal telah berjaya,” kata Wendy kepada Malaysiakini.

Jun lalu, kisah seorang jurutera di kilang di Selangor, Mohamad Azim Mohd Nor menjejak Wendy - yang hanya diketahui nama dan nombor akaun bank - mendapat perhatian warga maya.

Azim, 28, yang tersalah memasukkan RM1,600 ke dalam akaun Wendy, meminta bantuan pengguna sosial.


Tidak disangka-sangka, kira-kira 6,000 orang berkongsi semula statusnya di Twitter itu bagi membantunya menjejak Wendy.

Azim berkata dia terpaksa menggunakan cara itu memandangkan pembatalan pemindahan wang memerlukan pengesahan daripada pemilik akaun.

Wendy pula tidak dapat dihubungi melalui talian telefon kerana melanjutkan pelajaran di luar negara.

Menunggu harapan yang tipis, Azim terpaksa menggantikan wang peribadinya kepada seorang pekerja asing yang sepatutnya menerima wang itu.

Bagaimanapun, tidak disangka-sangka, selepas menghubungi banyak “Wendy Lim” di Facebook, wanita itu menghubunginya pada penghujung November lalu, menerusi Twitter.

“Saya sangat terharu bila Wendy beritahu yang dia mahu pulangkan balik duit itu,” kata Azim kepada Malaysiakini.


Wendy bertindak demikian setelah dimaklumkan perkara itu oleh rakannya. Wendy sendiri jarang menggunakan perkhidmatan bank itu.

Sementara itu, Wendy berkata dia memahami nilai wang kerana dia sendiri rasa berat berdepan kekangan kewangan untuk membayar yuran universiti.

Dia justeru memulangkannya selepas pulang daripada Australia.

"Ini motivasi terbesar saya menghantar wang kembali (kepada pemilik asal), dan yang paling penting, saya merasa dihargai dan kandungan mengetahui bahawa wang ini telah membantu Azim dan rakan-rakannya," katanya.

no one can take the money wrongly credited into their account anyway. under malaysia laws, the bank has the rights to reverse the wrongly credit amount, or if the person already withdraw the money, the bank can demand the money to be returned.

because, it is wrongly credited. it is not free money given. wrongly done means it can be rightfully corrected lor.

the point is, if you have wrongly transfer the money to a wrong person account, and there is proof that you have no reason to do so, such as purchasing a goods or service, you have your legal rights to settle the dispute by requesting the money to be returned. the person cannot win a court case by stating that you made a mistake and now the money is rightfully his. he can only win if he can shows that it is a rightful exchange. the court will look at the dispute and decide who should get the money, not blindly following a stupid rule such as if you transfer money wrongly, then it is your own problem and too bad you won't get back your money no matter what.

it is not necessarily a pain free process. but if you really really want to do it, up to the point of lodging police report and employ lawyer to initiate a legal suit, the person who receive that money has little chance of actually winning and will be forced to return that money.

You sure? I've heard some while back that the law won't get at you if you withdraw, mistake is simply that. What you said is just matter of moral obligation

well it is not. legally speaking. money incorrectly given to someone else by accident is still yours, because there is no legal reason for the other person to justified taking it from you just because you make a mistake.

a lot of people find this hard to believe, it is because a lot of us are brought up thinking that if someone gives you money by mistake, then it is their problem and you are free to spend that money without any worry. laws say otherwise.

the point is, if you have wrongly transfer the money to a wrong person account, and there is proof that you have no reason to do so, such as purchasing a goods or service, you have your legal rights to settle the dispute by requesting the money to be returned. the person cannot win a court case by stating that you made a mistake and now the money is rightfully his. he can only win if he can shows that it is a rightful exchange. the court will look at the dispute and decide who should get the money, not blindly following a stupid rule such as if you transfer money wrongly, then it is your own problem and too bad you won't get back your money no matter what.

He just bluffing by googling wateva he can get in internet. Not even a bank with that huge number of free lawyers able to win it let alone a single person.

Wendy pula tidak dapat dihubungi melalui talian telefon kerana melanjutkan pelajaran di luar negara.

Menunggu harapan yang tipis, Azim terpaksa menggantikan wang peribadinya kepada seorang pekerja asing yang sepatutnya menerima wang itu.

Bagaimanapun, tidak disangka-sangka, selepas menghubungi banyak “Wendy Lim” di Facebook, wanita itu menghubunginya pada penghujung November lalu, menerusi Twitter.

“Saya sangat terharu bila Wendy beritahu yang dia mahu pulangkan balik duit itu,” kata Azim kepada Malaysiakini.
Wendy bertindak demikian setelah dimaklumkan perkara itu oleh rakannya. Wendy sendiri jarang menggunakan perkhidmatan bank itu.

Sementara itu, Wendy berkata dia memahami nilai wang kerana dia sendiri rasa berat berdepan kekangan kewangan untuk membayar yuran universiti.

Dia justeru memulangkannya selepas pulang daripada Australia.

"Ini motivasi terbesar saya menghantar wang kembali (kepada pemilik asal), dan yang paling penting, saya merasa dihargai dan kandungan mengetahui bahawa wang ini telah membantu Azim dan rakan-rakannya," katanya.
