In Malaysia, the Notary Public or Commissioner for Oaths may take and receive the declaration of any person voluntarily making the declaration in Malay or English language in an appropriate form. A person making declaration by this Act shall pay fee to the officer or Commissioner taking the declaration. Any false declaration shall be punishable under the Penal Code.

Under Section 2 of the Statutory Declaration (Fees) (Amendment) Order 1993 the sum imposed for an attestation of a Statutory Declaration is RM4. 00 (for each document) and RM2. 00 for each exhibit attached

Easy to make, yes, but if you simply lie, you have committed perjury, which is punishable by the PENAL CODE. So it comes with very big burden.

Anybody can make SD. But if somebody who is on death row for a crime nobody can establish a motive for why he did it, people take notice.

Perjury is when you give false evidence in/during a trial. Making a false SD is like making a false Police Report. It is not the same. However, both are punishable under the Penal Code but different sections.

Btw, The Commissioner of Oaths is not liable for any false SD made. His responsibility is only to make sure the person signing the SD is the same person who is making the SD.
