My uncle purchase a double storey hse in a guarded and gated taman in Johor. He never stay there. but the hse committee is chasing him to pay the maintenance fees. Is it true that he is compulsory need to pay the maintenance fees? any expert, pls advise.
I have search the internet and only see that high rise is required to pay.

Is this GnG come with facilities (swimming pool , gym & etc)? if yes then you required to pay..

if No then it yes and no depend on what cover for the maintenance fees..

If strata title, YES. You have to pay.

That depends on agreement you sign I believe. If no sign, not pay also not guilty in court smile.gif

If you have to access using card for lift for example, they can block your access and you can challenge in court.

If Guarded & Gated, for sure need to pay the maintenance fees. Otherwise, where the money comes from to pay for all the vendor services.

Who's paying for the salary of the the guards and etc if not the owners of the units? Whether the owner choose to stay there or not makes no difference as the security and the maintenance services will still go on as a whole.

Refer to the handbook on maintenance and sinking fund if any otherwise the S&P doc for more details.

your question will be depending on: -

1) Stratified / normal landed ?

2) What is the clause in maintenance stated in your SPA ?


If this is a normal terrace house and is an effort from the residents there to collect fees from all resident to gate and guard the area, you have the right not to pay in legally sense.
