IMO

Firstly you have not mentioned which project is this, even tho many asked for it.

Secondly the compressor is blowing the hot air outside correctly.

Thirdly, this is supposed to be a yard, hence you cannot say it is your kitchen. Since the original planned A/C scheme was scraped, the developer has no choice but to put the compressor there as it is the most convenient and fastest way to put in the split units.

If you really insists to move it you can hire aircond ppl to relocat it to the outside wall, and that will make your condo looks ugly with compressors hanging everwhere.

The spa case you have to look for suitable lawyer/advocate/tribunal to see what rights you have in the original s&p to cover your loss/claims or "non- delivery" by the developer.
