 Developer mistake?, Booking fees paid, no unit lock

Hi everyone,

Need some advice for the house issues that I faced.

Basically, I had decided to buy a house in KL after a long search. In order to secure my unit, I have to pay 5k deposit and sign booking form. With that, agent and developer inform me that your interested house unit had been blocked, u can proceed for loan application then come back to sign SNP agreement if loan approved.

After my loan approved then we had set the date for agreement sign up meetup. But here the issues come before the meetup date. I received a call from agent to inform me about my unit had been sold out due to previous applicant's loan approved and bank release the payment to developer ad. The developer had made mistake thought that previous applicant get rejected loan and not interested to continue. But in fact previous applicant still interested and continue for loan application until now success.

So now, developer ask me to look for other unit and they decide how to compensate me. Developer also request only allow me to choose same size of the house which is around 1140++ sqft, if choose other size like 950++ then will not have any compensation.

From this stand point, I feel quite unfair to me. Only allow me to choose same size unit, if choose other size then will not have any compensation. The reason I have to let go my interested unit and reselect is because developer made mistake, but still treat me like unfair. Some more didn't mention what is the compensation on that.

May need some advice from everyone.
Anyone facing the same issue before?
In this kind of situation, what kind of compensation consider reasonable? Or what should I do in this kind is scenario?

very common practice as they tend to oversell like flight tickets because there might be 5 people interested but only 2 can get loan approved. They will make all sort of excuses in this situation. I think the market practice refund double the amount of deposit but yr dev might not agree. Most prob will push those undesirable unsold units to you claiming discount given for the fiasco. Know that you can place a private caveat for a fee on your property when you place a deposit. That would avoid such problem in future. That would force the dev to deal with you rather than whoever first bank loan is approved.
