Defence denies challenge to charge is delay tactic
Kamarul Hisham denied the service to the prosecutors is via email.

He said there is a hard copy served to the prosecution.



The lawyer denied it is a delay tactic as when there is a challenge to a charge, namely the charge cannot be made against the accused, then the application should be heard before the start of the trial.



Sithambaram said the prosecutor says the charges are not bad and there is no prejudice to Najib.



Before the stay was granted, they could have made the application.



He said the purpose of the application today is to adjourn the trial.



"They can do the application at the course of the trial. This trial cannot be scuttled further," he said

Earlier at the court complex lobby, Umno supreme council member Datuk Lokman Noor Adam points out the absence of SRC International Sdn Bhd CEO Nik Faisal Ariff Kamil in the trial.
Najib's legal team found that Nik Faisal has not provided any statement to the authority yet, Lokman added.

"He [Faisal] knew that the money should be banked into the account since Datuk Seri Najib was one of the guarantor for SRC International to get the fund."
"They are charging Najib first and investigating Najib later," Lokman said.
