First and foremost, just to clarify some misconception from many people:
1. AUCTION PROPERTY NEED BUY WITH 100% CASH.
Nope. You only need 10% as deposit, remaining can use bank loan same like subsale property.

2. ALL OUTSTANDING NOT COVER BY BANK.
Refer the POS. Majority banks covered the outstanding (maintenance fees, cukai taksiran, etc). But NO BANK will cover the utility (TNB, water & indah water). For TNB can actually change name without settling the outstanding amount.

3. MUST SETTLE WITHIN 90/120 DAYS. IF NOT FORFEIT THE 10% DEPOSIT.
Extension is allowable with valid reason. (certainly not because of pending loan / late loan approval / due to own personal reason, those all excuses that will not help).



Important thing to note when buying from lelong / bank auction:

1. 10% banker cheque to qualify to enter bidding. If unsuccessful, can take back the cheque.

2. Balance 90% can be cash or take bank loan or cash+loan.

3. Credit profile must be strong if plan to take bank loan. Cannot use gov loan (only can use for LPPSA auction property). Cannot mark up loan. CCRIS record must be clean with all zero.

4. Standby another 5% as legal fees, stamp duty and valuation fees. All this money is just the same like if you are buying from subsale unit. You need to pay the same amount of money.

No commission charge to client. Will claim from the auction bank if you are the winner.
(but for smaller bank, mostly no commission given out, so will have to discuss nego a reasonable rate)

Pre auction:
1. Understanding the risk in buying from lelong.
2. Site survey the property. Lelong unit can only be view from outside.
3. Verify is a vacant or occupy unit. Checking the outstanding maintenance fees and other bills (if available).

During auction:
1. Able to represent you to bid if you are not able to attend.

Post auction:
Ensuring smooth name transfer of the unit within the time frame. Engaging with banker / lawyer. Until successfully break into the unit including negotiating / evicting the occupant (for occupy unit).

Question:
Had a discussion with a lelong agent and he said sometimes Ah Long also put caveat to the property. So it’s vital to check the title.

Have u came across with similar situation? Can Ah Long put caveat to somebody’s property? 🤔

Yes applicable for already got strata/individual title unit. Not neccessarily ah long but any person with interest can place a caveat on such unit.

Therefore, for already issued strata/individual title unit, you must conduct title search at the land office to make sure the unit is clean from any of such stuff. These already got strata/individual title unit auction will be conducted at high court / land office. Not those auction by the private auctioneer.

So you are saying its not stated in the auction details, but us people wanting to bid should all go to the land office for a title search for each property we are interested in?
Any other checks besides utilities n maintenance fees we should look into?

Yes not all will be stated. Need to own do checking. Important stuff will be:
1. Caveat for individual / strata title property
2. Bumi / non bumi lot
3. Able to finance bank loan or not. Some property master title more than 10 years, developer bankrupt, those units will be hard to obtain any bank loan anymore. Or only limited bank offering loan.

After that only withdraw from EPF.

Depending on your account balance, 90% loan, you can withdraw 20% of the property price.

Here the form to fill up (yes got a special section for lelong/auction property in the form itself), can apply once you get bank loan approval of the lelong house:

Yes need to hire lawyer to assist and do the Deed of Assignment.
The lelong Proclamation of Sales (POS) is the S&P.
The legal fees involved buying from lelong is slightly cheaper compare to buying via normal subsale method actually.

1. Settle within 90 days or 120 days depending on which bank. If cannot, then lawyer will request for time extension with reasonable excuse.

2. By checking, yes can identify is tenant occupy or owner still own staying. Logically evicting tenant will be much easier process. Just like a landlord terminating the rental of your tenant.

Do banks in Malaysia offer pre-qualified mortgage services, as an potential newbie auction person, I'm most concerned about mortgage not qualifying for some reason, or only qualifying for 80%.

Yes all bankers able to assess how much you are able to loan base on your supporting document i.e. credit profile, income, DSR, CCRIS record. And will advice you how much you are able to loan up to XXX amount. Each bank got different criteria.
The assessment done sole on your profile, not related to any projects yet.
But also depend if you are going for project more than 10 years still under master title, then still got chance loan will not be approved. This time not because of you, but because of the project.

If confirm the unit occupied by tenants, after winning, the most important thing is to inform the tenants so that they stop paying rent to the ex-owner.
Next is the tenant demand back the deposit from the ex-owner. Logically, they wont be getting back those deposit as the ex-owner surely got no money anymore.
So just offer the tenants free stay for 2 months, should be able to cover back those deposits and do a new agreement with them. Either to move out after 2 months end or can continue renting (if you wish to rent out the unit). Make sure they settle those utility bill as well.

If you are taking bank loan, disbursement also will take 2 to 3 months time plus all the request to the authority. So during the 2 months "free" period for them, you are not paying anything yet also.

Example after getting a 450k unit at 300k only. 150k below market, I dont think you will mind so much about those pro rata issue on the rental or utility. As long as can get the bank to disburse and complete the process in time, should be the more important thing.

Got a unit at Flora, One South in the auction market now. High rental due to high demand from the arab.

3. Not necessarily. Most property bought before year 2010, even at lelong price today, owner will still get something (profit) out of it. So wont be declared bankrupt.
But for new property lelong today, majority sold below outstanding loan amount. So bank will continue to chase those owners for the differences. Then only they will be filed for bankruptcy charges.

For understanding,
First owner = Owner that default paying the bank and property kena lelong
Second owner = Buyer who win the lelong unit

For property age less than 10 years, still can get bank loan.
If more than 10 years, then only selected bank will give bank loan such as Public Bank and Ambank. So your choice bank selection will reduce.

If a property got good demand, easy to rent or sell, prime mature area, then even in the auction market also will not end up cheaply.
Most likely at 10% below subsale pricing only. So your profit will be less as well.

Is best to aim at non-prime local area you are familiar such as for example Rawang, Puncak Alam, etc.
Then you will face less competition and can get lelong units at maybe more than 30% below subsale pricing.
And since you know the market there, you will know how much able to rent out or flip the unit.

Another choice is to aim at places that gonna have new development coming in. Such as MRT2 stations, or new shopping mall, etc.
Then you grab a unit there first at cheap lelong pricing and wait for the development to complete. Current rental and sale price maybe at a low, so need to hold until the area boost up. However, this will require a lot of analysis and research.

General guess,
From the description, high possible is low cost property.

1. 20k below market price is significant for low price property.
Example: 120k market pricing unit going for 100k only.

2. Low cost property rental high chance able to not only cover your 90% loan installment, but also got positive cash flow. Rental minumum 600 for the above example.

3. Low cost property is hard to buy direct from the subsale market. Need to meet the criteria such as must be 1st home buyer, income not more than 5k, etc. So via lelong is the easiest method an investor able to collect many low cost unit. Some even willing to pay above market price for the unit.

Few example where from time to time will have lelong unit from that area at those pricing:
1. Flora Damansara low cost Block A B C
2. Damansara Damai flat
3. Bandar Sri Damansara flat
4. Impian Baiduri flat
5. USJ flat

Check at the nearest land office of that particular property. If got no time, sure can provide runner to conduct the search. No problem. Is RM30 payable to that land office + runner fees.

Need to have upfront cash in hand. Especially investors that already locked with 2 property, their 3rd property onwards can only loan 70% from the winning price. Will need to have more upfront cash.

That is why can see people still prefer to aim for mass market property at this range:
- Low cost flat below 100k at non prime area and around 150k at prime mature location.
- Studio unit at around 200k.
- Medium cost apartment below 300k.

Those listed above still the most sought after property in the market.

Fingers crossed. Hope that will continue to be the trend. Even one of the auction units that you have published: Tropicana Cheras was sold at 795k (4 bidders sad.gif ). And one of the units (No 12 Nadayu 1), bungalow was able to be sold at 2.6m this month - Not sure how many bidders for this unit lol

Let say, i go to land office to do lan search before auction and found the auction unit is not caveat. After winning the bid, can someone still conduct caveat? Is it possible for bidder to face this problem?

Yes, there is always a possibility the property being placed under caveat after the auction. You have to bear the risk.
As name transfer/change will take time. In between the transaction period after the auction, the owner name will still be the defaulter (ex-owner) name.

I have a question, I apologize in advance if the answer is obvious, but I am rather new to the scene.

Is it possible for bidders to intentionally not bidding if there is no other people bidding the property, thus lower the reserve price further? They then start bidding and fight once there is a bidder interested at the property. Can something like this happen? If not, why?

Yes, can. Even if you are only (sole) registered bidder, you can choose not place any bid and wait for next round.

But plenty of example, when next round price is 10% cheaper, will attract many bidders.
End up price higher than the previous round (the price you choose not to bid even when you are the only bidder).
So end up defeat the purpose of not bidding, hoping to get cheaper price.

Very very rare able to get full furnish unit. Can go for project that come full furnish from the developer such as Landmark Residence SOHO unit. But even if full furnish, there is no guarantee the owner will not come and take away all items.
As long as is vacant unit already a big bonus.

Yes, is better to go for the area that you are familiar with.
Around that area got few choices from 9ine Residence and Sutera Pines. Can get unit size around 1100 sqft at 350k in the lelong market.
Landmark Residence big size unit also available but dont think will drop to 350k.
All units here most probably still in brand new unit condition.

Yes depending on which bank.
HSBC did that before. Maintain or price drop 5% only.
Maybank also recently depending on which units. Some 20% drop, some 15%, some 10% and some 5%.

Generally the usual will be 10% price drop next round.

Yeah. As the T&C in the POS of course is always written to the favour of the auction bank and also up to the decision of the auction bank.
Atas budi bicara pihak bank.

At best is to judge base on past cases / past experience with the auction bank. Then again, bank policy also changes from time to time.

Example of few developers not allowing direct transfer.
Take note that if you buy lelong unit from projects already issued title but the defaulter owner did not do perfection yet. Prepare to pay the extra cost involved to do double transfer.
Stamp duty and legal fees to settle the title to the ex owner first. Then pay another round of stamp duty and legal fees to transfer to your name.
If taking bank loan, is not possible to settle within 90/120 days also. Extension required and penalty will apply.

In bracket is few example of project already issued title by those developer.
1. MKH (Hillpark landed houses)
2. Glomac (Saujana landed houses)
3. OSK (Mirage KLCC -do recheck whether need double transfer coz is freehold & Mirage By The Lake- yes, cyberjaya is limited freehold)
4. Tropicana (Tropicana Avenue)
5. F3 Capital (Selayang 18 & Univ 360)

Nope. Only 1 name allowed for high court/land office (title issued) property.
But subsequent loan can join name depending on which bank and the policy.

The MBJ house is actually Phase 1 house. I am unsure as to what is the latest transaction for Phase 1 houses but the latest transactions refer to houses that are built in Phase 3 (larger sizes)

As for Kinrara Residence, it is noteworthy that this unit is a Mahajaya unit, therefore you will need to apply for clubhouse access (additional RM150/month) on top of the RM150/month you pay to the security guard. Good thing about this unit is that you can shout from your front yard and the guards can hear you and you can have visitors parking in front of your house as the house is facing a divider. Overall, it is a good snatch for own stay. I would have bought this if I didn't purchase a subsale house in BK9 before auction date.

Well, will be interesting if not sold yet yesterday.
Vacant house. But got red "X" mark at the gate probably owe money with along.
But the local set up security personnel around will help out. Dont see that along problem is a big issue.

And got potential too. Walkable to future MRT2 station. Currently only got KTM.
Maybe due to leasehold? No idea.

No matter how many rounds re-auction without any taker, the unit will still remain exclusive for bumi buyer only.

High court or at land office mean the unit already got individual/strata title. Perfection done by the owner. Many season investors actually prefer such unit. Very straight forward process.

If still master title or title issue but perfection not done. Then will fall under public auction. Developer will play a major part on how quick the transfer process can be done.

I wanted to bid for Saffron (3rd time auction - schedule on Jul-2019) for reserved price of RM 486K. Unfortunately, the bank revised the auction price to 600K again. In my opinion, it's a bit phishy and not transparent.

I have been on the lookout for lelong properties in the past few months. Thanks for the update so far.

I have a question, can I assume most lelong property has its maintenance fees (if applicable) many months in arrears? Since most lelong units are defaulter, I assume the same apply for the maintenance fees, right?

A 1-2 years arrears in maintenance can easily goes up to 5 figures.

Yes refer to the POS.
Majority bank cover the outstanding maintenance fees up to thd date of auction. Some bank partial. And some bank no cover at all.

Probably ask the lawyer whos handling for free legal advice. Who knows, house may come with the car depending on the documents, haha.

Eitherway I know for sure you should not damage or sell it.

Worse case have it towed as its "trespassing". Maybe call the number at:

get the majlis to remove it. but maybe at the meantime, call some workshop to unlock it (if it is locked) and move it out of your compound to a safe roadside parking, and then contact the majlis.

Those already got title property (perfection completed), auction at high court or land office, the duration for re-auction will be between 3 to 6 months interval.

Those master title property of title issued but perfection not done, normal auction at public auction hall or hotel, the duration for re-auction will be between 2 weeks to 1 month (some even 2-3 months) time depending how active the banks. Here few schedule:

CIMB - 3 weeks once
Ambank / Alliance - 2 weeks once
MBSB / UOB / OCBC / HLBB / RHB / HSBC - monthly

And probably legal fees will be slight lower coz no need to do S&P. Just Deed of Assignment.

Risk:
1. Cannot check or know inside condition of the unit.

3. Hard to get loan if you buy a property that is more than 10 years still under master title. Example: Lagoon Perdana, Flora Damansara, etc.

Title is perfected and the title is clean, will be the most ideal situation coz name transfer will no longer depend on the developer (or liquidator if developer bankrupt)
Cash in hand:
10% as downpayment, balance 90% from bank loan (for your 1st & 2nd property)
5% as legal fees, stamp duty, valuation fees (some bank allow this to be partially included into the loan)

Got pro and con. Very much depending on your money and risk appetite.

New project
- Lower entry cost. Example, can just pay 1k to secure a unit. Rest finance in loan.
- Legal fees borne by developer.
- Need few years to complete while paying progressive interest according to construction stage.
- Unknown end product. All base on artist impression / scale model / marketing brochure etc.

Subsale or Lelong

- Location. Far away in the middle of nowhere place such as Savanna Executive Suites by Mah Sing or landed property then is Bandar Hillpark by MKH. Even Eco Majestic also not able to escape from lelong.
- Price. Maybe got high cash back last time. Bought at wrong price (overprice) such as Verve Suite OKR, M City or majority Cyberjaya condo. Can read back the thread in the forum here, some people even said is cheap launching price during that time. So got people end up buying straight many units in a go.

Lelong transacted history will not show up or appear in JPPH record. I got no idea why.

Not all bank allow you to finance legal fees (including stamp duty) and valuation fees into the loan.
To be on the safe side, is 10% downpayment and another 5% for legal fees and stamp duty. For subsale/lelong property.

Plus for lelong, case by case basis. Yes will have additional cost that required more cash in hand.

How much cash u can afford to fork out if ur budget is 400k?
No cash, then chances are u can buy new launch which is not cash heavy.

Cash rich, then can consider lelong coz typically can get deal 20-30% below sub sale.

Most importantly, the location have to be good.

No different for EPF withdrawal for lelong units. After sign the POS bring it to EPF and can start the withdrawal process.

Caveats means 1 or more other party claims their interest on the said property and file a caveat via land office to prevent any selling/buying on the said property. you need to find out whats the reason for the caveat and deal with them. Mostly will be like the previous owner owe other bank, developer or LHDN money.

Actually now got a lot of properties below bank market value.

Good locations with mature residents (older projects) are hard to find in lelong, while the one which is really cheap location is not nice and mostly high density new projects.

Most of the properties can buy back to 2012 prices.
Even if lelong maybe get back slightly lower than launching prices only.

Ah, sorry for the late reply but thanks so much for the info. In your earlier post, u mentioned that "MUST SETTLE WITHIN 90/120 DAYS. IF NOT FORFEIT THE 10% DEPOSIT". What exactly must be settled in that time period? Is it the 90% loan approval?

Yes, paying the remaining 90% amount either by full cash or finance using loan. The auction bank just want that amount of money.
Any delay or extension is up to the auction bank whether to imposed penalty or not.
Some bank is okay lenient no penalty for extension.
Some bank is okay no penalty for extension provided you take loan under the same bank. Meaning for example Maybank auction, you take loan with Maybank.
Some bank really strict. No extension allowed. Mean you burnt the deposit straight if required more time.

Will PM you recommended unit base on your criteria.

Thought banks will do all the due diligence ??
How can that happen ??

I see the biggest risk of lelong is that some title problems that cause 90% loan release to delay.
Then cause 10% deposit to be forfeited

For lelong properties, Bank would not do the due diligence. Its the buyer need to do their own due diligence. Its all stated in the Proclamation of Sales clearly that buyer bear their own risk. Thats the reason why alot investor say standby the cash if go for auction, in case unable to disburse your loan on time, can pay cash first, then once the caveat removed, can do refinancing.

Yes, even before auction checked no caveat, but once you bidded during transfer process can have a caveat if there is any private caveator with caveatable interest etc. it might happens.

Not the highest floor. Ground floor is number 1. Level 1 is number 2 and so on.

Meaning developer issued out strata title to all owners. But this owner did not do perfection which mean appoint lawyer to do MOT and pay stamp duty. This process not yet being done. And the buyer from lelong will have to complete this process after winning.

haha, this one too expensive already, 1 mil beyond budget. how about puncak jalil bro? any good deal there? only requirement is got space to park 2 cars inside with ample walking space and a small terrace, 2 more car park outside gate vertical, and can park 2 more cars on the roadside. if can fit 3-4 cars inside gate is the best. got 6 cars at home, preferably corner unit actually.

kind of a new-ish "premium" development in that area, very deep into mahkota cheras, way pass the shoplots which is still acceptable. to go into the semi D you have to turn in from the main mahkota road into older 2 stories development then left right left right then only you reach your guard house.

what not acceptable is that every morning, that 2KM stretch along the shoplots are gonna jam for a minimum of 20 to 40 minutes before you join CKE for another 30 minutes jam into Eko Chears (if you're working in KL/PJ/center of selangor)

now even if you're going into Kajang/Puchong the traffic is crazy as well. if you can work on odd hours and sitting in cars for hours is fine for you then mahkota cheras is a very good place actually, a lot of shops and amenities, i love that place during non peak hours travel. been looking at mahkota but realize i still have to go to work in the morning and im not willing to sit there for a couple of hours just to get into another jam.

Hi Gurus,

I have a question regarding joined name house if gone in to auction, the remaining proceeds from the auction after all loan and fees paid, the amount will go in to owner acc based on S&P owner or loan acc owner?

The S&P is joined name but loan acc may be 1 name only.

If to S&P owner, they dont have a joined name bank acc and not intended to have 1, will the remaining proceeds be split evenly in to 2 cheques?

Proceeds from any sale (auction or subsale) goes to settlement of outstanding loan and all cost first and any balance theteafter will be split evenly among the stakeholders.

In the event the sale proceeds cannot fully redeem the loan, the stakeholder who is the borrower will be responsible to settle the balance.

Property still under master title = not possible to put caveat.

Is because no extension allowed for high court auction. 120 days is ample time to complete the process since title already issued and got no caveat by other party.

Thanks. Was planning to look at it again if it comes up. Its a pretty strange unit. At the back of the house, is a Hyundai. Probably hidden there to prevent it getting repossessed by bank. But that will be a headache later, as in how to return it to whichever bank has a claim on it.

I actually know someone selling their SD10 house due to migration. I reckon it's a nice place, not too congested, and you have more than one access road from your house to the central loop. The roads are a bit narrow so you can't parallel park too many cars . Nice safe neighborhood with access to the Central Spine for jogging.

Thanks for the insight on Lelong Prop and listing. i read this thread from your first post after being recommended by a friend to lookup for your thread in LYN.

Im currently eyeing for Lakefront Residence T4 to be exact, there is this one unit T4-18-01 which was on auction for 405K. lelong date late last month, not sure the status if its sold or taken up. Would you be able to check if its not and advice possible re-auction date if yet to be taken? as you mentioned it may take 4-6 months before re-auctioned.

and do you have any listing at lakefront residence cyberjaya either 950sqf or the 1293sqf (dual key unit). prefer T3 or T4 only.

1. 10% deposit to enter bidding. (few bank required only 5% nowadays).

2. If win, then need to standby to appoint lawyer and take bank loan to cover the remaining purchase price.


Same like subsale, legal fees and stamp duty (if you take 90% loan) is approx 5% of the purchase price.
Some portion of loan legal fees and stamp duty can be financed into the bank loan. So no need to have full 5% cash in hand.

Then there will to pay outstanding maintenance fees and cukai taksiran. Mostly bank will cover but is you pay first then only claim back from the auction bank.
So far base on experience, only auction under Citibank will issue you cheque to pay the outstanding, so you dont have to pay first.

Is free of charge for majority of the auction bank. Such as CIMB, OCBC, UOB, RHB, Maybank, Hong Leong, HSBC, etc.

Is it true if I am applying loan from a different bank than the auction bank, I’ll need to pay for another valuation fee? Can’t we use the same valuation report by the auction bank?

Completed project all required to pay Valuation Fees.
Subsale also the same like lelong. Paying the same thing.

All banks applied the same ruling. Once you signed the Loan Agreement with the bank, bank will appoint their panel valuer to conduct valuation to the unit.
Even if you use back the auction bank, you will need to pay the valuation fees.

Same like legal fees. Valuation fees is negotiable.

I would like to ask what happen if bank auction a property and able to collect much more than the debt balance? Is it all belongs to bank, or bank will only take the outstanding balance, and return the rest to the previous owner?

For example outstanding 200k, market rate 400k.
Bank sold at 380k, who will get the additional of 180k here?

If is stated bumi lot, then ONLY bumi can bid.

BUMI LOT and bumi registered owner are two different thing. A bumi registered owner is not necessary bumi lot but a registered bumi lot is BUMI LOT.

But if the tenure is leasehold and a bumi registered owner, state consent is required for transfer.

And if is freehold and a bumi registered owner, transfer to non bumi is no issue.

If bid bumi lelong unit, 90 or 120 days is not enough to complete the transaction. The auction bank will more likely to forfeit the deposit.

Dont depend 100% in POS. Do a land search to be safe.

I bought a freehold govt housing through lelong recently and I still have to apply for consent from the state housing agency.
