 Dealing with RUDE landlord, Please help

Hi,

Helping my younger brother with his current issue.

Status: currently "renting" a house property for the 3rd month.

Tenancy agreement: not signed because house have few unresolved issues from landlord thus my brother is delaying the signing part.

1) he rented this property via SxxxxRent service. Owner bypassed them and deal directly with my brother. Informations posted in the advertisement are inaccurate (example, 5 A/C posted but only have 3 A/C, all bathrooms equipped with heater but actually none)

2) referring to point 1, house owner agree to install water heater but has failed to deliver despite many weeks/months.

3) owner came to the house on 2/8/2018. I was there in the morning thus I was able to finally "meet" this landlord. He came to collect rental for August. My brother told him that he need two more days because his pay cheque has not been cleared yet. Landlord merely answered in a rude tone "if like this delay me two days better I rent house to Indians"(I don't know why he being racist and chosen this race)

Funny part is, I kinda like jumped into their conversation and mentioned that if he doesn't want to fix the water heaters and defects(3 door knobs are broken, pipe is leaking), then I will find people to repair and pass the bill to my younger brother to be deducted from rental. It's the 3rd month and he never bother to send anyone to come to check. My brother has the records of conversation of him reminding this landlord about these problems. Try to guess what the landlord answer me when I told him about repair part? "We also didn't sign agreement how can you minus from rental?"

Another thing, on the same evening while my brother was still working.. this owner came into the property and try to open the sliding door using his key. Thank God my sister in law was there and landlord was freaked out before he just walk away.
Now my question is,

1) does my brother has the right to just move out without notice just to teach this landlord a lesson? (Note: deposit also haven't pay so we are on a winning side I guess)

2) any suggestions on how to deal with this type of landlord?

If there is no agreement signed, then just walk away.

Can landlord lodge police report or worse sue my younger brother? Owner has the ic photo copy though

Here is some additional info, my brother and his wife+newborn just shifted in on the 7/6/2018. Instead of pro rated he paid fully one month rental. July rental was paid on 26/6/2018. I feel is really ridiculous and inconsiderate of landlord to come to the house at 830am morning 2/8 just to ask for rental. No messages or calls in advance or reminder about rental collection though it's tenant responsibility to make payment promptly.

I believe as long there is no paper agreement that is signed and not legally binding, even if the landlord proceed with any legal actions, I don't think he would want to sue your brother. The legal proceedings cost more than what he would want to sue for.

Anyone can lodge a police report, anyone can proceed with legal actions. The question is whether it's worth it or not.

From my point of view, there is no strong case for the landlord.

But I do suggest try to settle it properly to avoid unnecessary trouble. You do not know what the landlord is capable of.

I told my brother not to pay first because I want to help get more opinions. Personally I feel that if this owner can do this for the first time, there will be sexone,third and so on in future.

in malaysia, there is limited law protect landlord

so bad tenant or good tenant can just leave the property and nothing much landlord can do.

walk away now if no black and white tenancy agreement
rather than having to deal more problematic issue later

So my brother actually made a half month rental few days ago to buy himself some extra time. Owner has been spotted passing by in front of his unit few times(maybe checking if run away?)

Fear for his safety, I get My friend who runs a CCTV business to help install few units of CCTV temporarily (good to have such friends that willing to help) and place it at prominent spot. Pretty sure landlord noticed these CCTVs.

Some neighbours actually told my brother that he should just move out and destroy some items in the house. Seems the neighbours also dislike the owner? Lol

hes actually stalking your brother and his family? thats a bad enough sign to ask you to move out right? better to be safe than sorry friend, especially he just got a new born. i will think of family 1st rather than, worst come to worst can tumpang at a friend's place until he sort things out.

i believe since nothing is signed he should just leave with everything intact, i'm not sure if he can actually put a back feedback on tenants like airbnb can post comments about guests that rent their place.

furthermore he can walk into the house with extra keys, who knows he will steal things or harm his family.

move away. block his phone if you have to.

For own safety, just move out.

There is limited action the landlord can do to him.

If you are worried, take a video/pics of the condition of the property prior to moving out

The main priority is always safety.

My bro and SIL currently packing their goods and will need probably another few days to complete packing. In mean Time, each day after work I will help to pickup some of the boxes and place it in my house first.

As far as I am concerned, landlord is in home appliances business in Kota Kemuning, shah Alam. Further research indicate that one of his siblings is a so called gangster in the area where my younger brother is currently renting.

Question: is there any suggestions to safeguard during moving out? Assuming potential harassment.

phew, i dunno man, probably move out late at night? best is you can do it one shot. like one of the poster said, snap a pic of every nook of the house to avoid dispute.

1) bro and SIL will move out on 30/8
2) take photos and videos of house condition prior to moving out


Is there anything that they should be aware of or should do to safeguard themselves?

Not sure if this week is possible. House have quite a lot of things to move. Unless get professional movers but don't think my bro can afford such after spending a lot recent months.
