Hi sifu sifus. I am looking for advice with a small situation I am having with my landlord.

I recently rented a condo with an agreement that the landlord would thoroughly clean up the unit before I move in. However I found the master bedroom curtains to be filthy hence I loaded it into the washing machine. Lo and behold, the curtains fell apart as it was really old and brittle. Same will happen to the living room curtains if I tried to wash it.

1 month has passed and yet the agent that I am dealing with has not provided replacement curtains. Excuse was the owner was out of country and will only look into it when he is back.

What should I do or rather what can I do within my rights to get this sorted? I am using a bedsheet as temporary curtain now and it does not fully cover the window!

Would it be against the law to replace curtains myself and deduct from rental?

1. There is no laws on replacing curtains yourself. Curtains are not ‘fixtures’ of the house.

2. Whether you can reduce rental or not depends on landlord's permission.

3. There is a device called The Internet™, you can using it with software called Whasapp™, iMassage™, Facetimus™, Lime™, WeCina™, etc. to have chat with your landlord in almost anywhere in the world.

4. I don't think agent are paid to manage your problem (depending on the contract). They are paid to get people to rent the place. However, since the landlord is oversea and busy, agent usually serve as unpaid middle man.

5. I recommend Ikea GLANSNÄVA curtain liner. It works well to block sunlight. Please buy relevant hooks. Ikea price is online and quality is good, price is okay.

6. Your situation can viewed as one where landlord refused to repair certain stuff. You can use some lawer-ly jargon to defend yourself:
  1. Refer to New Zealand tenant laws for lawyer-ly jargons

  2. Read your contract. Is curtain part of the contract? If not, read and screenshot the original ad. Does ad says "fully furnished"? FYI, landlord can argue that curtain is never part of the contract (if this is true, then game over).
  3. Write official 'notice of remedy' to landlord. Please state that the damage is one that make the house 'uninhabitable' (cannot sleep at night and too hot in the day). Refer to your contract on what is deemed official writing to landlord. Usually, your online messages will not count. Only ‘registered letters’ counts.

    1. Ask your agent for the Malaysia address of the landlord. Say that you want to send official notice to landlord.
    2. Also, ask the landlord to formalize your 'formal communication' thru Email™. That way, you don't need to send registered letter (probably, not sure here, may at least need landlord to send one registered letter to you).
    3. Needless to say, you will need to keep all documents (and screenshot of online messages, ad, etc.) regarding this dispute. Pretend that you are going to have to present the proofs to court one day (however, most likely, you won't).

  4. In the case where the landlord refuse (or ignore) request for the repair (usually 30 days after official notice) (and you already replaced the curtains due to urgency of this case), then terminate the tenancy.
