 HELP - Developer taking too long to fix defect

Hi all,

i am in need of some advise - more of your experience and attending to this from a legal point of view

i submitted my defect list in February and until now, they are not completing the job. latest promise was on may 25th that it will take 2 week....and i've just visited the place and the flooring has been removed....effectively another 2 weeks delay

in the S&P, there is a clause of 30 days completion of defect submission hence i am considering legal action to get some compensation from this large and well known developer.

I've been renting a house and plan to move in March but until now, i have to serve both rental and loan repayment to the bank. i am struggling and feeling victimized by this action in delaying the remediation of the defects.

please help kind sir's and ma'am's to advise how do i best position this to my best advantage againts this developer

I really think you left out chunk of important detail. It is impossible for the developer to delay your defect from February until June. Something must have happen in between either u keep adding defect or unsatisfied with the job/material

U can try but do bear in mind, the procedure is far from easy.

Keep your defect list record. Issue a letter of reminder to the developer after 30 days as per the clause in your SnP and refer to it.

CC to all parties i.e. consultants.

Make sure u get acknowledged receipt from the developer on the letter. Repeat for every 30 days after with reminder no.2 and 3. After reminder no. 3, seek housing tribunal for case advice. With the paper works in order, then only they(housing tribunal) will be able to act on it.

Hi,

Just wanted to know, what if the door position is not the same as the layout in the S&P? Can we make defect rectification request based on that?
