 Late housing delivery, developer ignore LAD, Need helps from expert

Hello, I have bought a property in Ipoh dated on 25 Jan 2015 in S&P. Currently, received a letter from developer key is ready to collect. But they have late delivery for 1 year. I have submitted a letter to management to demand a LAD from them. The developer Keris in Ipoh keep delay the claim and person in charge always in meeting, can't arrange for a meeting. I got no feedbacks from them at all. What are the steps should I take to get their awareness? I read someone articles said the effective way is to lodge a report in housing ministry in putrajaya. Property I bought is in Ipoh and the developer in Ipoh too.

There is a housing tribunal which allows you to file to claim up to RM50,000 for one incident. If you file one claim for LAD, it does not prevent you to file further claims for, say, defects.

Yup, I did a Google search. Housing tribunal only in putrajaya right? No branch in Ipoh.

You might max need to come Putrajaya 3 times for the court to award you the LAD. It's worth the trip if you really keen on the money.

At tribunal level, a court is not involved, and no lawyers there, except for the chair, whom usually come from legal background. Unless when either party is not satisfied with the award by tribunal (to challenge the legality of the award, not re-evaluate the claim and award) then the case will be referred to the court, then you will need to fork out money for a counsel. And upon hiring a counsel, your expenses will usually exceed the max claim of RM50,000, which does not make economic sense.

Usually 2 times can settle. 1 time to submit borang 1 and 1 time for the hearing.

The process is fairly simple and does not cause you much in the sense of the 'tribunal judge' usually side purchaser. And for TS case, it seems like a straight forward case which is developer fault due to late vacant possession.

Go to housing tribunal unless you want loyars to get rich.

Seriously though, do it fast because developers will always delay paying LAD even though it's a plain and obvious case. By submitting your claim to the tribunal, it will prompt settlement.

25 Jan 2015 S&P, now VPed is about 3 years and 2 months, you said late delivery for 1 year which mean the developer said your property will complete in 24 months?

do it fast, you can only file LAD case within 12 months from ccc date. hearing usually after 1-2 months after filing at Putrajaya.
