Is It Legal For Security Guards To Keep Your MyKad, Scanning on mykad reader? Photographing?

Many office buildings now require you to give them your mykad which they put into a mykad reader & download our photo & details. In condos, security guards ask for visitors' mykad & photo scan the mykad. i wont produce or let them hold my nric/mykad. always insist on producing drivers license. as what i know..only polis can ask for your mykad. then again he/she must id themselves as polis.

I read somewhere it is illegal for a non-government organization to hold on to your IC and Drivers License.
They should write down the details of the visitor and return your identification card.

There is no Malaysian law that allow other people (polices even) to held your private identity documentations (MyKad or driving license even) when entering private/government buildings. You may present the ID prove visually if required, but never allow other people to held your IDs.
I have entered data sensitive data centers (including government buildings in Putrajaya). The auxiliary polices and guards did not held by Mykad or even driving license. They just cross check with their requests for work documentation and then allow me to enter for work. They just gave me the visitor's pass to be displayed when on premise.
All these practices are basically illegal, just like charging percentage of credit card transactions, or having a minimum for credit card transaction. We are used to doing these illegal things everyday.
But hey, for further clarification, get a civil lawyer to explain the law for you.

They are not allowed to keep your MyKad, usually they will settle for Driving license.
But, they can also reserve the right to refuse you entry because you do not want to produce MyKad.

It's absolutely illegal. Only yourself and valid government agencies are the ONLY ones allowed to take and withhold your personal identity card.
Frankly speaking the security personnel and the owner or management in charge for most premises ignore this however let's say if they still insist to withhold it and somehow manage to lose it or anything unsavory happens to your IC then they will be a big trouble as you can report to your local police station, those responsible for the witholding and losing the IC might even have to face prosecution for charges such as identity theft.

They retained my MyKad and customer's PASSPORT. Couldn't do anything about it as they said leave it there or leave there

My place the guard wont take mykad to hold, they said illegal for them to hold it.. but they do hold license or student card.

I went to balai polis.. and the police at the guard house took & keep my ic in exchange for customer's pass.

Once i went to pos laju at old lcct,they will take ur ic before you can enter .if you refuse to give then they won't let you go in.

Malasysia version Area 51  each pass give u up to certain level of privilege (yup security purposes, if in level 3 but u can't show level 3 pass, ur reward will be live bullet)  this is army, give u a little hint: army speak english not bahasa Malaysia
