Hello everyone,

Helen is a fresh graduate and newbie in “M” S/B. Management of this company is “very special” and her Boss is a cunning person. Senior A was played politics and asked Helen to resign due to Senior A’ own benefits but she refused to resign. Therefore, Senior A was played tricks and complained to Boss. Lastly, Boss was terminating Helen immediately without giving notice via verbally for his own benefits and he is more depending on senior A while Helen is a newbie. So Helen was requested termination letter from her Boss but her Boss was refused give termination letter and said will pay salary included pay in lieu of notice to her.

Now “M” S/B was refused pay any payment to Helen. What should she do to get her justice?

Ya, lodge a report to Labour Department.
This is unlawful dismissal where employee was terminated without valid reason.

There are few steps to do before terminating an employee, like:
1) Show cause letter
2) Warning letter
3) Counseling etc

Unless she had gross misconduct like conducted crime, breach of trust etc.

Anyway you can't just terminate anyone without strong reason.

permanent or probation? if probation boss can dismiss helen anytime without pay to helen unless it is say so in employment letter.

permanent can go labor dept complain.

if look at both helen and boss objectively, this case wont even able to classify as unfair dismissal or constructive dismissal.

the root cause could even be the HR hired wrong ppl without communicating with senior A.

but what i heard from hr is the another way round, usually employee will win the case with the help of department of labour

But still, an employee cant be terminated on the spot without valid reason kan?
Unless the employee is under probation period, then can say the employee is not suitable for the role and tell her off.
P.S. I'm not an employment law expert, just my opinion. biggrin.gif

She should hint to her boss that she may file a sexual harassment suit against them...

But seriously, I think the law is on the employee's side, especially when she hasn't receive any termination notice. So, she's still officially an employee. If she's not paid, she should complain to EPF too.
