Nope, Nintendo warranty doesn't cover this. Read the instruction manual page 74, Note 8.
-> High-precision technology is involved in manufacturing LCD screens, even so there may be some pixels that are always on and some that do not go on (dead pixel). This is not a defect, but the current state of the art and is not covered under any warranty
Should be careful next time to check the whole aspect before buying it.
Added on April 22, 2007, 4:30 pmBtw, if the store owner (whom you purchase your NDS with) are compassionate enough in your case, he might offer his service for free.

well i did ask about the seller regarding warranty issues, including the dead pixel and like D.Sync said it's not cover under warranty. i dunno is it my eye too sensitive or what, i asked my friend just now they say they din see the defected pixel, but i did see it wor, and when i shutdown my NDSL the defected pixel gone, mean it's not an ash or whatever right??

Well, if you see the dead pixel, you certainly did! No one knows your NDSL better than you right? Try and play games that switching screens continuously, such as Pokemon Diamond/Pearl.
-> Enter inside and outside a house, it will constantly switching the screen between BLACK and graphical images. Try and notice if there's anything unusual.

Getting Started

|
I have a dead pixel on my camera. The screen is soo small the dead pixel (which is RED by the way) is really really noticeable. As for the DS, the screen is quite big and so some people don't notice the dead pixel. I heard thatt some people enjoy staring at stuck pixels on their consoles just for fun.
