Nope... Apple will claim that battery degradation is a normal process. Unless your battery fails to charge or fails to power on then you could claim for a new one.

Mind telling us what is your charging pattern?? Do you always charge your phone when its around 20% and charge it all the way to 100% ?? Or are you someone who always charge your phone regardless of the battery percentage??

If you must really buy an iPhone, now would be the worst time to buy a new one either retail or from telco. I'd get a good-condition used one.
