 Agricultural Land Question

Hi, planning to build house or do some small business on this land but i saw "This land is to be used only for agricultural purposes" on the land lease.
Possible to change the use of the land? If so, what should i do? Go to land survey?
Is it illegal to straight build the house or start the business without change the use of the land?

Don't think you can build a house ... maybe a small hut or something. Better to go to the land office and get a definite answer

If you want to get it done properly you have to change to 'kediaman'.

Although I know of many Malays that simply build their bungalows on agricultural land just because of the apparent allowance for a single house on the land. Not really sure of the legality though.

I also came across one plot o f land listed as commercial, can the status changed to residential? i wonder if the former tax is more expensive?

Can apply to change but depending on land office.

Not easy + tedious process.

Depending on the nature of the activities you want to do. If your business is processing the agricultural stuffs then it should be fine.

Also, on land titles with agricultural category, you can build a house for own/employee (agricultural activities) stay, provided the house occupy less than 1/5 of the whole area of the land or 2 hectares, whichever is lesser.

If you intend to do other things than that, you will need to apply to land office to change the category of land use to either building or industry (town planner to submit for planning approval first, then land surveyor to apply for conversion), then architect and engineers to submit building plans, only can start building after obtaining all approvals. After finish building, testing and investigation, architect will issue a certificate of completion and compliance (CCC), only then the owner can move in and occupy the buildings.

If you want to operate business, you will still need to apply for business license, of which they will require you to produce the CCC for application.

You may refer to National Land Code 1965 and Town and Country Planning Act 1976 for more details.

any idea whats the law or act for sarawak land related matters on this?

how about to use the agri land for comp site biz ?

post MCO, quite many ppl going for natural @ camping etc...

possible to use agri land for such business purpose ?

My view on this. Natural @ camping = Tourism / Services. There is change of the land usage from agricultural to tourism / services. You may need to apply change the land usage purpose.

For country land < 4 hectares , the land title should be under Land Office Title. You need to go to Pejabat Tanah & Galian Daerah.

For country land > 4 hectares, the land title should be under Registry Title, You need to go to Pejabat Tanah & Galian Negeri.

I find this thread interesting

But I can offer my opinion

By the same token , if you use Your home as office or run a small biz, do you convert your house to commercial property? You can ask so many villagers doing that sort of Industrial Kampung Kevin, do they do that?

Of coz not.Why the hastle?

So this boils down to enforcement vs law.

If you are doing small small biz and building small small house, staying low profile and plant some fruit trees , using agricultural land , dont disturb and upsets your neighbors, you will be fine.

Law permit one house on agricultural land.
