Based on demand.

If everyone sells at 4 and hot demand then someone will sell at 4.1, 4.2, 4.3 etc and price goes up.

Likewise, if market keeps listing at 4.5 and no buyer then list at 4.4, 4.3, 4.2 plenty of buyers then price goes down.

Court cases memang take time, Jeremy Hogan, one of the lawyers who is following this case on youtube commented that it'll be around October/November for us to find out. So far, it has been going in Ripple's favor as well.

Addendum, do ensure you have sufficient cooling as well. The rated Th/s is based on 25 degress ambient temp for optimal usage, and maintain below 40 degrees at the very least. Do take this into account when you're looking into mining with ASICs, not to mention the electrical requirement. DYOR.
