 Tenant damaged house,did not pay bills

I rented my house to a tenant . Tenancy ended on 30th april 2017.
He asked for a few days to fix the house. He texted me to meet up yesterday 4pm to handover keys.

Unfortunately he did not turn up. Did not amswer phone.
When i reached the house, doors unlocked. Several items missing from the house and house badly damaged. On top of that, bills around rm2k unpaid.

How do i proceed with legal action with this tenant?
Anyone has recommended government lawyer?

didn't you have like 2 months rental deposit for that? And also maybe some utility deposits?

When you rent the house better to get the tenant to apply their own power and water

The deposit is not enough to cover the damages.

you can try to sue them but then its a civil case and will take a long time until settlement. Good luck

submit his details to CTOS so he will be blacklisted from getting loans in the future

Quite Impossible to CTOS a person due to rental la. Tenancy expired already summore.

Unless you engage him in a civil suit, the suit will be recorded in CTOS.

If not, I don't see how to get him blacklisted.

how much u will suffer loss if u dont claim back from him?

what u mean by government lawyer? lawyer who do case for free?

if u want claim from him, yes it's civil suit and takes long and probably the legal fee cost more than what u want to claim from the tenant.

You want to sue him, you will have to get your own lawyer. There is no such thing as govt provide lawyer for you to sue somebody. If there is, courts will be filled with lawsuits from every tom dick and harry.

Make a police report with your tenancy, start a civil suit.

you may try to file your suit via tribunal of consumer claims. I have heard some of the success stories on rental dispute while attending my hearing there.

I think that you can make a police report for vandalism, but whether they will charge him depends on the police. It will be your word against his.

From my experience, if you know he cannot pay and the amount is less than 10k, accept the loss. Take it as bad experience. Put a curse on him. smile.gif

The time to be picky is when you get the tenant.

I had spent 6k ( case was about 5 years ago) on a lawyer and the house was sealed, his stuff was to be auctioned. I had to pay two guards so that he won't remove his things. But he slipped out in A LORRY according to my neighbour.
The security company gave all kinds of excuses. I am very sure he was in cahoots with the tenant. The 'biznez man' tenant had such cra*** stuff, I would be lucky to get 1000k.
I have had good tenants and annoying ones but not a shyster like him - claimed to be Datuk. Better to keep my house empty until I am sure of the tenant.

The thing about tenant is u always have to filter them out. U have the rights to pick who u want to rent to. It also helps to always maintain a good relationship with your tenant.

lawyer wont take this case coz no valid agreement between u and tenant.. thats y must take deposit and filter tenant

Sure many more of this kind of tenant didn't pay bills, one of my friend got into same situation, tenant only paid min monthly electricity bill just to ensure no black out . Owner only knew this after tenant moved out. doh.gif
