Hi,
I'm currently an expat here in MY since November 2015. I filed my 2016 tax last week and I'm abit confused regarding my tax return.

I filed an eM(2015) form last April 2016 since I'm not yet eligible for eB(6 months thing). I did not go out of MY for more than 12 days during that time so all should be good.

Fast forward to 2016 filing, I filed my eB form and all went well.

I checked my tax return for a 2016 and looks okay.

Now my question is will I get a tax return for the excess tax I paid from Nov and December 2015? I paid around 28% of my salary for the first 6 months of my stay here, then went down to normal tax rate after.
I checked my eM form in hasil but no mention of tax return for 2015. I haven't received my 2016 tax return btw.
Thanks.

No, you wont... Its consider burned money on 1st year working here in Malaysia.

During that period you are not considered as resident tax payer of Malaysia. Only subsequent year (in terms of tax) then you follow the same rate as local.

The girl that attended me in LHDN last week made me list all my in and out of MY stamped on my passport. She also made me a letter addressed to their director or something that says im requesting for his approval to convert eM (2015) to eB(2015) since the lady told me I'm qualified to do so. And that's what I did. She told me they will have to update my 2015 filing to a resident status instead of foreigner.
