Non-stamped agreement is still a valid and legal binding one. But in case there is any dispute between the signing parties and requires the agreement to be admissible to court as evidence, it has to be stamped then (which will attract penalty due to late stamping).there are lawyers that say that any agreement that is not stamped is also legal but am not sure how true this is..
