Finally I met some few owner and the end we find out below:
1. Developer is trying to play card with us, they dont want meet us and just ask us to deal with lawyer
2. I met some owner the end and we are going to tribunal

Finally I get my key..but how the developer force me now....?

1. they use 60% of my purchase price insists of 100% to calculate
2. They have included DIBS and make my LAD become negative.

Can they use DIBS to do this way? I'm so sad!

History...........

I'm on the buyer in V residence under MAC developer and currently, I facing an issue of the LAD payment and the fund return.

I do not sure am I lucky or not because when I bought on 2013/4 they offer me air corn & some fund return and after 3 yrs we are able to get the house key BUT i'm facing a lot of problem there.

Bad & Low service not even efficient and strong team to support us. Officer keep provide the answer:

1. Dont know when is the actual date HQ (Melaka) will return the fund to you.

2. LAD have pass to lawyer and dont know the actual figure

3. Ask the lawyer team - Shui Tai, than they only reply few words to me "noted & thanks....."

Appreciate you can share with me if you face the same issue or how they tell you the procedure & progress....

yea... it's start building before 2014...for sure already saw them clearing the hill and making fOundation when I was working in DHL before I joined the company now for 6 years...

just went to get the key last friday.. a lot of things need to be settled by macvilla..quality was poor for workmanship..also eager to know whn they will refund for LAD..not so much idea.. bangwall.gif

OMG, I think the same issue will happen to me soon. This is why I open a topic here, like you mentioned no clear information from this developer, all are TBC. We did keep chase and follow up but the standart answer is DONT KNOW. s

Nope. they didn't provide exact date for LAD. They just give the lawyer contact for us to contact. it is all up to lawyer, we need to do by ourself

i think usually the lawyer is the one that calculate the LAD based on black and white milestone dates that they have. just go check with your lawyer and submit the LAD claims.

not ask you to argue. but gather the buyer crowd and pressure the developer to solve it quick
so i advise you to create watsapp or FB group to discuss the strategy and work together to pressure the developer.
im here to help not to proof im better.

Refer to your SPA. It should be the prescribed Schedule H according to Housing Development Act. If it is, then you are entitled to payment of LAD immediately upon VP.

If not, pls bring your case to the Housing Tribunal.

Refer to SPA Sch H, Clause 25.(2). LD is based on 10% per annum of the purchase price.

On your second issue, as DIBS is not a standard specification in Sch H, you will need to read the fine prints of any supplementary agreement governing the DIBS. If it is not mentioned specifically DIBS can be used to offset the LD, then they cant.

You should seriously approach HBA already.

maybe..we also did not get that offer..but we received letter from shu tai earlier last week. Macvilla opted to pay RM5000 only instead of LAD total payment..just went to KPKT and report to the tribunal

I dont think so because we call the lawyer but Ms Ho like dont know anything and also dint not offer anything to us.

I did met some owner, same offer they provide but the end also not news.

So did you went to KPKT and report to tribunal already? When will be your hearing? mine will be on end of this month. Let see what will happen. Not happy with opted RM5,000 payment from Macvilla thru Shu Tai letter.

Im an owner as well and I've actually engaged a lawyer and already sent demand letter. I think KPKT tribunal can handle max RM50k only so if beyond that you need to use a lawyer.
I would like to be included in any owner-only chatroom as I would like to work together else we all won't get our LAD etc.

Normal prob with smaller developer.

They will want to only pay half or less of LAD amount....

Bigger developer oso have late delivery issue...

But they will direct pay owner their entitlement without haggling over it

This is just a DELAY TACTIC. Please get included in the whatsapp group for owners and pull in all other owners too. Pls PM your mobile so we can include you. You should file a claim with KPKT tribunal asap too. Only costs RM10 and a few hours of your time in Putrajaya.

It's lucky that this project VP and not abandoned. I always wonder who will buy this since the location is a bit odd. It's on the boundary of Cyberjaya, yet coming out from the condo, u need to go out all the way until near 16 Sierra and turn back to get to Cyberjaya.

Some more it's right beside highway and HTC. Good luck to investors. Own stay if accept the above, it's not bad coz spacious size condo at very cheap auction price. But at this price u can get in cyberia, right inside Cyberjaya where everything is nearby.

Isn't this the long overdue development, situated at the turning in into Cyberjaya flyover? Was an eyesore, but not sure what's the progress now, hope already complete and owners can live there.

I doubt anybody able to rent out also.
Anyway, lelong got a transaction sold at 590k for the unit with the same size and low floor as well.

And got plenty of other lelong units in the market slowly dropping in price now.

This should not considered as cyberjaya. It leasehold unlike other cyberjaya props and at the border before puchong n cyberjaya comes with crazy high tension cables. From day one it couldnt sell and lucky enough to complete. No way near amenities there. Jialat. N good luck

unlikely to cancel both, but the access road need to really tune up.

I also have no idea who think it's a good idea to get a property at that location. It must be one with loads of cashback or high commission to sell. Some guru will gladly promote.

It's at a location not inside cyberjaya, and even if it's just on the border, it's not convenient at all going in and out of the development. Buying at cyber valley is much better than this.

is it dirt cheap?

i think as many unit lelong, and many owner also in bad shape wont keen to pay maintenance fee.

doubt the condo is in good shape.

i know for rental isn't so crucial, but then again this condo smack in between 2 highway with limited accessibility.
think gonna be like dead will little or no activities.... if that what you looking for then good lo

This condo are consider pulau meranti side and not part of Cyberjaya. Wonder why mislead ppl as part of Cyberjaya area 😅

This is used to be high cash back project last time and I believed the market here went through some correction period now

For own stay yes but for investments think twice because this area certainly are not targeted cyberjaya demographic tenant due to the access issue hence it's won't bring an good rental yield / capital gain.

In short, Cyberjaya ppl wouldn't prefer this condo given there is so many choices available out there

For title wise may check with the management office to be more exact but if I am not mistaken those first hand buyer SPA price are quite high,may need to factor in this as hidden cost as well
