 Discharge of Charge, Looking for the Computation

Hi there,

Recently my parents have receive the quotation from a lawyer firm, but my parent were shock as the price is higher than average market price about 20-30%, so I would like to find it out.
Below is the expenses for the discharge of charge for the property, for Comparison purpose, refer the link in below @ 2010,

Would like to seek some answers from you all, appreciate your help! My questions are:



1) Under Legal fees,
I) the Deed of receipt and Re-assignment
The price they charged has goes up from RM300 to RM400, is this price consider higher?

Under Reimbursement,
i)Transport / Travelling expenses / Courrier Charges = RM250
Comparing to 2010, it goes up from RM100 to RM250, Extra RM150 reasonable?


ii)Telephone, Faxes, Photocopying, etc = RM 200
Does it cost me Rm200? it sounds reasonable?

iii)Miscellanous = RM50

same ? I guess it is fine.

2) As this the Solicitor contacted us first, I m not sure who pass my parent contact to them or they are the only party that are allow to do this discharge.

So do I allow to appoint any other solicitor firm to proceed this discharge?

Discharge of charge (title case) is to be differentiated from Deed of receipt and re-assignment (non-title) case.

Fees as provided under the solicitors remuneration order is RM300 for discharge while for DRR, it is Rm300 + revocation of PA 100. see page 16 - http://www.malaysianbar.org.my/index.php?o...oc_view&gid=545

Travelling for DRR - will need to go to bank once to deliver documents, once to collect documents, once to stamp office and once to high court to revoke PA. Normally, 100 to 150 is reasonable depending on how far the places are from the lawyers office.

Telephone, faxes, photocopying etc - 100 to 150 should be reasonable.

Stamp duty will be 4 copies x Rm10. Revoke PA should be around 50.

Miscellaneous - standard is 50.

Total should be around 750 - 800.

Normally, bankers pass the contacts.

Yes, you can appoint another lawyer to handle it.

i am also supposed to discharge, so far too busy to look for a lawyer. can anyone recommend a lawyer in PJ for this (SS2 area)?

Yeap, RM400.00 is the rate prescribed under the SRO.

The travelling is a bit heavy considering that they only need to travel to the bank, the developer's office and the high court... probably only once.

The telephone looks reasonable to me, maybe you could get a RM50.00 from them though :haha:

You are lucky that they still charge RM50.00 for MISC cause the new SRO amendments pumped it up to RM100.00 already.

With respect of representation, you have the discretion of appointing a different firm of solicitors to attend to the discharge but such firm must be in the bank's panel of solicitors.
