 Landlord not Fulfilling Terms and Conditions, Refused to provide promised fixtures.

I have recently come into an agreement to rent a dssd directly from the owner. After negotiations, he agreed a basic rental comes with basic fixtures; lights and fans for all areas/rooms and 2 Unit of Water Heaters.

Paid Deposit on 10 September 2016. Got the keys to the house on 1 October 2016. Installation of the fixtures has just started. Accepted explanation in good faith. By mid October, Landlord informed only installed 2 Unit of ceiling fans because only 2 wiring points and hooks provided by developer. Owner not willing to spend money on extra wiring cost (not to mention the fans).

Installed water heaters also do not work due to a basic non built-in pump model. Owner said not going to change.

Since middle of October till early November, he offers no real solution to the problems and getting impatience with me when I kept telling him to fulfill our tenancy agreement. When I put forward a solution on how to tackle the problems, He literally told me to leave the house if I don't like it and stated he will return my money.

Now that I've agreed to his suggestion, he said he will refund but with deduction (as of now no amount indicated yet). In good faith, I have paid up the total deposit due (payment via Internet banking) and the Tenancy Agreement hasn't been properly sign, due to some changes in the document and he doesn't have a soft copy of it (or so he claimed). Note that I have not started staying in the house but in the process of moving my stuff.

Questions /Discussion

1. How much should the Owner refund back to me?
2. Since he didn't fulfil his end of the agreement, and ask me to leave, shouldn't he compensate me instead of deducting my deposit?
3. Welcome any suggestions and feedback

the owner should refund full sum back to you as he did not fulfill his side of the agreement. Yes by right he should also compensate you but I doubt he will as from what you have written he seems to be an irresponsible and unreasonable person.
Anyway, ask him to compensate but if he doesn't there really nothing much you can do..

Infuture please note

I) do not pay the full deposit in advance..pay one month and just before moving in, inspect the house and make sure
everything is done before handing over the balance.

2) when you pay the one month deposit let the owner sign a paper to say that he wl refund you the money just in case the house is not delivered as per agreement.

3) insist on signing the TA before moving in

In cases like yours, using a good agent will smooth over the whole process for both parties.

Thank you for the above comments. Yes, that's exactly my opinion too. He should be refunding me my deposit and if he has any balls at all admit to his folly.

He's a professional (physician) and he didn't strike me as someone who didn't have a basic common sense and knows what's right from wrong. Truth be told I just wanted to help him out a bit and put trust in a fellow mankind. Boy! Do I know how to pick them.

I just got news from him that he wants to deduct 1 month rent, management fee and utility bills.

He doesn't know head and tail about tenancy agreement; and refuse to educate himself I guess. Maybe that brain of him only can safe medical jargon.

maybe if you can get a lawyer to send him a letter demanding for full refund + compensation he may not be
so gungho as to deduct at his will..
