 Bumi lot to non-bumi (freehold), no consent needed?

doesnt matter freehold or leasehold. the important thing to look for is "RESTRICTION IN INTEREST / SEKATAN KEPENTINGAN" on the title.

if it doesnt have any sekatan AND it's not a TANAH RIZAB MELAYU then bumi to non bumi wont have any problem (because u dont need to apply any state consent so the land office cannot restrict u

laymen in malaysia basically equate freehold = no restriction and leasehold = got restriction.

it's totally 2 different thing. not saying you're wrong but it's the wrong mindset to have generally.

This mainly applies to sub-sales.

If buy from developer, then developer has the right to reject as they have to meet certain quota if they dun wan to kena penalty.

whenever a property needs state consent and it involves a bumi to non bumi (except for malay reserve land, which cannot transfer to non bumi at all), each state will have their own unwritten rule to say that the bumi owner must hold the property for at least X years before allowed to dispose it.

any rejection can also be followed up by an appeal citing the reason the bumi owner want to dispose (u can say pay medical bill for parents etc make them kesian u abit) but there's no hard and fast rule to say whether can transfer or not.
