Recently, a court in the USA has ruled in favour of plaintiffs in their suit against Nvidia over false advertising with regards to the GTX 970. Among other issues is the claim that the card comes with 4GB of ram.
If we get hold of the written judgment, we may be able bring a similar case to the consumer tribunal here in Malaysia.
Unfortunately, Nvidia does not have an office here in Malaysia, which means we have to take it up against the distributor for "A False Or Misleading Conduct, False Representation Or Unfair Practice, That Is - A Misleading Or Deceptive Conduct As To The Type, Manufacturing Process, Suitability For Purpose, Quality And Quantity;"
I know, it's not fair to blame the distributor, but in our complaint, we can suggest that they seek some remedy from Nvidia HQ. On top of my head, one remedy is for Nvidia to issue coupons that can go to our next Nvidia purchase.
I know, USD30 is not a lot, but I think we should take a stand.
Why am I suggesting this:
1. We shouldn't let Nvidia get away with this. They can't be wrong in the USA and right elsewhere.
2. This will encourage distributors to keep their suppliers honest on behalf of consumers. A good way to build brand loyalty.
3. Although it has been four days since the verdict, Nvidia is keeping quiet about 970 owners outside the USA. If we don't at least try, we are allowing Nvidia more privilege to act dishonestly outside the USA.
Here's what I propose:
1. Look for your receipt and packaging. This will help our court submissions.
2. PM me to indicate your interest and email address.
3. If I receive a few interested parties, I will consult legal and consumer rights experts for advice on how to proceed.
Let's give it a shot guys. Nothing to lose.
EDIT 1:
- So far, 24 hours later one PM. Means there is one guy who has his receipt and packaging. Hope we can gather more.
- I'm currently abroad. I'm setting a tentative deadline END OF OCTOBER. That's when I'm back. We don't need to rush this. The more claimants we gather the better.
- This is uncharted territory for me. I will make mistakes. Keep it constructive guys.
- Should I post on Idealtech's FB site? Good exposure. But is it right to "tumpang" on a merchant's page?

- No luck. No judgment. It was a settlement. Looks like we will have to rely on press reports.
