i bought an apartment last year, already received the keys and living in this house for 3 months.
then my lawyer call me about this fees
Perfection of Transfer RM1023
Perfection of Charge RM4371.49
after 50% discount

she said she sent me the document already, but i haven't look at it.
what is this? i thought everything settled already.

I already paid:

deposit
bank loan Lawyer
S&P Lawyer
Stamp duty

Yes, i called the agent, he said this is subsale. He never mention before. if not subsale then NO fees like this?

Your neighbours all got their individual/strata title dy?

Quite similar to my case
I bought a townhouse and the vendor din't get his title from the developer (bankcrupt) when he should before selling to me
So I ask the vendor to pay for the transfer, as the property when sell to me, should come with the title together
If i'm not wrong this is called perfection of transfer (POT) = developer xfer title to vendor
But this is my case la, by right i think the vendor should pay for it

Maybe other sifus have better explanation

Perfection of transfer and charge happens when the individual title or strata title is issued in respect of a property. It can happen anytime when the prop is still owned by the 1st owner or it has been on-sold (ie subsale)

Yes, you will be responsible for the cost. Your POT charges seem reasonable but POC seems a bit high. If this is the same lawyer who did your loan ladt time, then it shd be lower (assuming your loan amount is not that high)

usually transfer of title for strata property wont be so fast after vped. it takes btw 2 t0 4 years....if low cost...some takes up to 10 years or until the developer gone bankrupt.

the seller cant do anything, and he has one year from the issurance of such title to make payment.

if you buy this property before the title is transferred, then its yr responsibility lioa. usually the seller will liaise with developer to transfer the title directly from developer to new owner (you) by paying them some fee (few thousand)...otherwise the developer will have to transfer the title to the original owner than he will have to transfer to you...hence take longer time for the perfection of you getting your key.

under the new strata title act 2013, by right the developer will have to get this sorted out once the building is ready for vp...but so far I dun see this happening yet....many people must be still sleeping.

p/s- by right your lawyer should have informed you about this cost is forthcoming

my mum got a house under government loan and fully paid just last year, but haven't receive the loan settlement letter from government. then the developer is asking my mum to do a MOT.

so can i just ask the lawyer to do Perfection Of Transfer only without Perfection Of Charge since the house loan already settled but pending government letter?
