Who's the subject of being scared here? The accused. What's the point on putting him on fear when he already (allegedly) commit the crime? If its mental, its to deter others from commiting the crime, thus scarring the public, not scarring the accused.

So what? Are you saying because the punishment is done is public, its more effective in deterring?
