My spa is under schedule h. In my case, the project was delayed for 12 months. the vp date under the SPA is Feb 2015 and the property vp in Feb 2016. Ntg was communicated to us by developer on the EOT before VP and we proceed to claim our LAD via tribunal.
Suddenly, we receive a notice from developer today that the EOT was approved in Nov 2015 which is after the VP date stated in SPA. the condition stated in the approval of EOT is the developer has to notify the buyer on the EOT.
My question
1) EOT approved in Nov 2015 but we only receive it today. before this, we only receive a copy of letter from the architect (1 months after vp) that developer applied for EOT. the letter is dated march 2014.
is this consider a proper "notification"?
2) am i still entitled to claim the LAD?
