I'm having the following problem and your team hasn't provide the solution yet. My tenant is giving an excuse of mco for not leaving my unit within the agreed date.
However, I can't allow him to overstay due to the reasons:
1) it was agreed multiple times that tenant will moved out from my unit on 29th April. Thus, it is tenant and prospect landlord to plan this in advance during the mco situation.
2) the mco doesn't restrict tenant to move to your new place as long you have a valid agreement with the prospect landlord. this approach has been checked and approved by new tenant with the police.
3) it is a crime for overstaying at my unit without landlord approval as stated in the tenancy agreement and can be detained as breaching of private property.
4) my insurance will be expiring on 28th April which will not be applicable for overstaying and this is unfair for me incase there are any goods are damaged.
5) existing tenant had been informed about my new tenant about the urgency to move in to my unit since she's pregnant and her in laws are staying at block A ken rimba.
6) my prospect tenant can sue me for not fulfilling the agreement date on 30th April for moving in to my unit since both parties have signed and they pay the full deposit.
