I read all the post but i Need to ask about the new tax relief for Assessment 2008. Refering to..

http://thestar.com.my/news/story.asp?file=...7846&sec=nation
http://www.hasil.gov.my/cP/upload/Budget/attachment09.pdf

So when i was doing my e-filling for 2008, I didn't see any place for me to put this new tax relief figure like travel allowance, housing allowance. So how do I states those?

In my EA form, it states

Gaji Kasar (SALARY) : 20000
Allowance : 10000

So when I fill in the pendapatan in BE form, i put only 20000? Last year for 2007 when allowance is taxable, i put the combine total.

Thanks.

What ronnie says is correct....in that it is simply excluded from the Tax Computation...IF, you have the amouont appearing in Section G of the EA form.
Hi Trevor,

Im looking at my EA Form now and i don't see this section G. Is it because it is the old form not mean for the new policy in 2008 YA?

Some info on my EA form. It is (C.P.8A - Pin. 2008) at the header and it does states Cukai Pendapatan Bagi Tahun Berakhir 31/12/08 as the title.

A. Butiran Pekerja.. my info etc..

B. 1. Gaji Kasar ... RM12345
Fee ...
Tip Kasar, perkuisit penerimaan sagu atau elaun-eluan ... RM11111

2. a. until f.

The allowance i get actually is listed under the B. 1. Elaun-elaun.. RM11111.

I don't find a section G on my B. 2.

Am i using an outdated EA form?

did you check all the pages? some of the main figures, you click on a button which takes you to a popup page, you do the breakdown there and the main figure gets calculated automatically.
*
i checked.. all the buttons for extra form is the usual one we get every year.. there is no new button i'm aware of..

those i see are like

1. Pendapatan Berkanun dan Jumlah Pendapatan (Statutory Income and Total Income)

- Dividen (HK3)
- Derma and Hadiah

2. Tuntutan Pelepasan (Deductions Claim)

- Pelepasan Anak

3. Tuntutan Rebat / Tolakan Cukai / Pelepasan Cukai (Rebate Claims / Tax Dedutions / Tax Relief)

- Tolakan cukai seksyen 110 Akta Cukai Pendapatan 1967 / seksyen 51 Akta Kewangan 2007 (dividen) (HK3)

These are all the buttons i saw and i clicked all of them.. is not them.

As i understand it, in your case it does not matter as company was reimbursing you rather than paying you an allowance.  So therefore, you are not entitled for the allowance.
hi Trevor,

no.. it wasn't reimbursement.. it is my fixed allowance that i get every month and it appears in my payslip as allowance. I do not need to submit a claim form for it. I believe i'm entitle right?

so now, i think the issue is my employer use the wrong EA form? i haven't see the new EA form yet. Assuming i can talk to my HR to ask them to give me a new ER form.

Am i right to say that the RM11111 under B. 1. Elaun-eluan.. will be moved to B.2.G?

So, when i fill in my Pendapatan, i only enter B.1? But on my EA form, there is a Jumlah figure for B.1-5 and C. Usually i put this Jumlah figure in all my previous year filling.

Hi Ronnie & Trevor,

Well the RM11111 is just a simple figure i put out for the discussion.

In my payslip, it will states clearly,
1. Parking Allowance.. RMxxx
2. Transportation Allowance.. RMxxx
3. Handphone Allowance.. RMxxx
4. Accomodation Allowance.. RMxxx
5. Others Allowance.. RMxxx

All these adds up to become my monthly allowances on top of my basic salary.

Then all these monthly allowances add up to become my annual RM11111 (fake number) allowance listed in my EA which I told you guys.

While i know some of the allowance up there may not be exempted but some of them certainly do.

My question is not about am i eligible or not.. i know i am eligible for some.. i have the proof.. etc... but

My question is how do i file them in my e-BE form for these new exemption introduced for the YA 2008.

As I do not see any way in my e-filing there that allows me to explicitly include this figure for deduction of taxable income like what i can do with computer, epf, books and etc...

So the only way is to put a "manually reduced" total income? is that the correct way of doing it? that is my question.

thank you.

Ah yes Ronnie.. thats the answer i'm looking for..

conclusion, my employer shouldn't add up all my allowances that are exempted like what they have been doing for the past few yrs.. then my total income will be reduced.. and hence my taxable income.

thank you!

For your information, the IRB allows companies who have difficulties to calculate the tax-exempt income (Item G of the EA Form) to use the old formst of Form EA (without Item G). These companies are required to submit to the IRB the details of Item G by 30 May 2009. Since it does not affect the employees' tax, this information need not be disclosed to the employees.

Therefore, some companies use the new format while some companies use the old ones.
why is it not affecting the employees' tax? the item G suppose to be exempted allowances figure of the employee. without it, our taxable income is higher.

However, please note that the EA form does not show the income with the exempted amount removed!  This means that if you are taking the income directly from the EA form.....you may be declaring your income as being higher than it should be.

TAXSAYA, automatically takes the section G (if you have it in the EA form, otherwise you need to be able to prove that the amount is exempted) into account, so that you do not need to worry about recalculating things in the HK2.
Hi Trevor, I finally get to look at the new EA Form and there was a G section for the tax exempt.

Assuming i have allowance A, B and C, whereby only A and B is exempted.

Originally, my EA form Section B, is a total of

1. Salary
2. Allowance total of A,B,C

which total to be my taxable income.

So if im declaring my allowance A and B (since it is exempted now) to section G. Does the Section B allowance still show a total of A, B, C or just only C? from what you mentioned above, i gather that it should still show the total of A, B, C. Then if i take the total income at Section B, i'm still being tax at a higher income. Do i manually deduct my income before putting into e-BE form?

Also, my HR say something is not so easy and u need to justify i rili use that amount.. like your distance from home, monthly usage of ur mobile etc etc.. i was wondering, since it is a fixed allowance, why do I still need to justify. All along i only know that if you wanna claim variable allowance, you only need to have receipt to justify it.

thanks
