 Condominium Facilities, Need to pay for using condo facilities!?

Normally the condo facilities like swimming pool, tennis court, badminton court and gym room are open free to use for the condo residents. When I moved in the condo, the swimming pool and gym room were not ready to use. After 1 year, the gym room were completed but management office required the residents to pay if you need to use the gym room, badminton court or tennis court. They said the maintenance fee is not included for condo facilities. This is ridiculous! mad.gif Why I need to pay so much maintenance fee for no facilities condo! mad.gif

As we know the condo facilities are one of the selling points for the property and stated in S&P. I would like to know, the management office have the right to collect the fee from the resident for using the facilities? Hope someone can answer this and suggest some solution to solve this problem! notworthy.gif

That sound ridicilous btw how much u pay for the maintenance now? if 0.11 or 0.15 than i understand why u need to pay more for facilities. laugh.gif

no, swimming pool gym tennis court should be free for residents.

somtimes i have seen management collect fee for use of function room to host parties.. or visitor short term stay car park... but not for gym.

but having said that i have seen newer development where there is a pay per use facilities like rooftop swimming pool, for example the Empire SOHO at d/perdana. (that one is serviced apartment so all facilities need to pay.) tht was told to me by the REN when i view last year

the management can only impose fee if instructed by the JMB (Joint Mgmt Body). so either the committee make own decision to increase collection, or probably during AGM majority residents vote for fee imposed.

maybe the fund is very minimum and most of the resident against for the increment.

can know which condo is that ?

It is a condo, not a service apartment. I guess the collection decision is made by the management committee members, didn't go through the AGM because this year do not has any AGM. I think the main problem is because >70% of the resident are tenants and students. Most of the house owners didn't pay the maintenance fee. Anyhow it is not fair for those house owners whom paid the maintenance fee without any facilities. We already suggested the management office to disconnect the water supply to those didn't pay maintenance fee but they said they do not authorised to do that because it is individual meter. Any suggestion?

Question, does the owner pay water to the condominium management or direct to supplier i.e. Syabas?

Unlikely landed property, the pipping is laid by Syabas from bulk to distribution channel and lastly to the water meter. The water meter demarcate the boundary between the water pipe belonging to Syabas and the land owner. So if you don’t pay your water bill, Syabas has the right to remove the water meter.

In a condominium, the pipping are all laid by the developer. It runs internally within all the common area and maintained by the management. Also, the demarcation between Syabas starts with the bulk water meter. I can say with certainty, your condominium is continuously paying the water bill for everyone (including 70% of those defaulters). If your condominium has defaulted, Syabas would have disconnected the bulk water meter and everyone won’t have any water to use.

If they say the water meter belongs to the owner, as management, I will go to the water meter room and turn off the master switch before the water reaches the owner’s meter because that is common property.

How old is your JMB already? Am starting to smell something rotten.

Management has no right to turn off individual meter, but management has the right on the common facilities.

Normally, in highrise, individual unit's water is supplied through the water tank above the building. Water tank and valve in common facilities is under management control. whistling.gif

Strange owners pay direct to Syabas?

In any case the classic method as you mentioned would work, I interviewed a management company for the replacement of our manager. This particular company's director is quite interesting because he sat on the consultative panel prior to the enactment of act 663. So I asked him, how to deal with defaulters, so he said "one" of the method is by lowering the water pressure. Surprised, I asked if it was legal cause some people have cited human rights/basic necessities etc...? He responded, he still gets water right? ... i was like... doh.gif

Your condo is already 3-4 years old?! Should be a management corporation by now or in the process of converting...

anyway, you should pressure the current committee to hold an AGM to better understand what is going on in the condominium and to table accounts. If there has been no AGM held prior to this, they are definitely in breach of the law. You may want to raise a complaint to COB to take action.
