This is what happened with another property by MK*.. property in Kajang.
Deliver different from SPA. change something without buyer consent. HAve solid proof that their model house showed and item listed in the SPA schedule 4th..
1. Went to tribunal and they said its civil case.
2. Send demand letter to dev and in return developer threaten to sue buyer if this is taken to legal proceeding..
3. File complain to KPKT and they said there is no provision in the agency to take any action except sent them letter asking why they change the items stated in SPA. They can only ask but cannot impose fine.
KPKT and tribunal to protect buyer? Emm I doubt.
Go civil case, even if we win, developer will appeal. At the end, we spent 100k for compensation of 10-20k? Developer is listed company and plenty of lawyers behind,
Same issue with developer in Eko-wol in Semenyih.. 850 sqft apartment sold for 259k.. price is ok based on the developer name but end up common walkway is cement rendered. OMG!!! Suddenly you feel you bought a medium cost apartment far from kl for this price.
Anyway, this is the risk..They will promise everything in order to get you sign the SPA. What we can do? Maybe avoid this developer in the future or expect the worst and pray for the best..
don't make unnecessary scream first.. eco world apartment is either 800 or 900 sqft, not 850.. and it's cement render b4 signing snp whereby buyers r aware of it.. btw I never see sp setia or eco world having corridor tiles for their apartments, be it in setia alam or ecohill or majestic..
