Is it possible to DIY name transfer from parents to child?
If yes, whats the procedure and fees involved?
If no, how much is the legal fees if need lawyer?

Everything is possible, but highly advisable to get a lawyer as there are many steps to be taken. It is not so simple.

Legal fees - will be based on value of property (will probably bill based on estimate and later on adjusted based on valuation by JPPH when transfer is submitted for adjudication).

Stamp Duty - will be based on valuation by JPPH. For parents to children, there will be a stamp duty remittance of 50%. Will need to provide birth certificate for your lawyer to submit to LHDN for adjudication.

If there is a restriction in interest, your lawyer will need to apply for state consent as well if title is issued.

If there is an existing loan, i.e. property is still charged/assigned to a financial institution, it will have to be redeemed first as well.

You can walk in to the respective land office and ask for the exact steps.

To do and complete the entire procedures for first timer will cost you a big headache and time consuming which would cost more than you paying for the exact legal fees. biggrin.gif

Use the calculator as provided -)

If the property is still under financing better seek advice from lawyer.
If the property already redeem, you still need to seek advice from lawyer
but the cost is much lower.

Conclusion, ask lawyer tongue.gif

For your case considered transfer of property under "Kasih Sayang", there wont be any stamp duty charged under this category. Highlight to IRD/Land Office that you are transferring from parents to children. There is a way to escape the lawyer fee ie fill the Form 14A yourself and get ADO Assistant District Office to witness your signing of transfer.

Hi, only transfer between spouse (husband and wife) is fully exempted from paying any stampduty. Father / mother to son / daughter is only available for 50% waiver ya. biggrin.gif
