Does that mean I do not need to pay any tax and tax filling since I do not fulfill these 2 criterias?

by the way, you can ask the one who told you not tax resident thus no tax to be paid fly his kite.

non tax resident = flat rate, no tax relief bla bla bla yada yada. still taxable.

while you are here. im not sure your employer will do it or not.... by right your company should inform LHDN that you are going overseas.... if you want less problem, better call them up. get the form/letter, inform them that you are leaving for overseas.

YA 2018, the following 30th apr will be 30th apr 2019... that what it means.

work in singapore and work in a singapore company are completely different thing. did your girl friend explained to them that she work in a singapore company but based in malaysia? and where did your GF goes to work? SG or MY? and im quite amazed that the SG company doesnt provide EA form? most importantly, does she pay tax in SG? biggrin.gif

time for me to learn things, i never handle overseas company branch in malaysia before... parking here 1st.

that is only 1 type, there are few more ways to qualify as tax residence of malaysia.

normal penalty = max 300%. SVDC = 15%.

Penalty =/= tax rate. you got the idea totally wrong.

tax base are based on schedule, its not simple 100k x %. it works like this :-

example 2018

Chargeable income = RM70k

1st RM50k = RM1,800
remaining 20k @ 14% = RM2,800

Total = RM4,800


If you under declared RM10k

Total RM80k

1st RM70k = RM4,800
Remaining RM10k @ 21% = RM2,100
Penalty 15% on RM2,100 = RM315

Total payable RM7,215
Less : Paid ( i assumed you pay already ) 4,800
Balance RM2,415

This is what i believe, of course. Its always better to walk in la....

your situation is a bit special because it involved few issue.

1st, you need to know malaysian tax is territory taxation. so the moment you earn your income in Malaysia, you pay malaysian tax no matter who pays you your income. So you its simple as you stay in Johor, travel to Singapore daily to work, bring back the bank to malaysia. You are not taxed here. but if you employed by Singapore Company, bank into your Singapore bank, BUT you stay in Malaysia and work in malaysia (Maybe SG bracnh office in JB), then you have to pay malaysian tax. IF you pay SG tax too, then 2 outcome. Either you not taxable in malaysia, or double taxation agreement kicks in.

Please do not get yourself confused by 'foreign income is not taxable' because the definition of foreign income is based on derived in malaysia or derived outside malaysia. the derrived in simple but not 100% means work/earn in malaysia. Imagine 100% export oriented Company in malaysia, unless they setup in freezone, else they pay tax like normal Company in malaysia.

2nd, did your Company register a Company here? If no, did your Customer pay for withholding tax ?

cant advice more, its too complicated. but rule of the thumb is call LHDN and clarify yourself.

in short, yes need to submit. and yes they will refund if they decide not to tax audit at the moment.
