The Kuala Lumpur Traffic Court was told today that the two Myvi drivers accused of reckless driving were on the way to attend a birthday party when the road crash occurred on the Duta-Ulu Klang Expressway (DUKE).

Company executive Muhammad Firdaus Roslan, 28, said he and 10 members of Familia Myvi Club (FMC), including the two accused, were heading to Publika to celebrate Siti Noor Aini Mohd Said's birthday.

He said the group had earlier gathered at a restaurant in Gombak and then decided to go to Publika in their respective cars.



"Before heading to Publika, four club members and I went to a car wash at Petron in Jalan Ampang to wait for two new club members, including Mohammad Fizal Reza, to join us to go to Publika for Siti Noor Aini's birthday do," he said during examination-in-chief by deputy public prosecutor Suhaimi Ibrahim.
He was testifying in the trial of Fizal, 31, and Siti Noor Aini, 36, who are charged with reckless driving which caused the death of Fairuz Nizam Husain, 35, his wife, Nova Safitri Azhari, 27, and their 6-month-old baby, Nur Firuza Annisa at Km6.2 of DUKE Expressway from Ulu Klang heading to Jalan Duta, between 12.31am and 12.35am on May 2 last year.

Firdaus, who is the eighth prosecution witness and a FMC committee member, said he was driving to Publika in a Vellfire and was ahead of a Myvi driven by a club member called Zahid when, after passing the Batu toll plaza, he realised that no other FMC members were trailing behind.

Following which, he said, he drove his car to the side of the road to speak with Zahid, who informed him that Siti Noor Aini had been in a road accident.

Firdaus said he then exited the expressway via Jalan Kuching to go to the scene of the crash, where he saw Siti Noor Aini was lightly injured in the lips and the body.

He then took Siti Noor Aini to Kuala Lumpur Hospital (HKL) for treatment.

The hearing before Magistrate Zilfinaz Abbas continues tomorrow. – Bernama, March 2, 2016.

A witness told the Traffic Court in Kuala Lumpur today that she saw yellow and white Perodua Myvi cars graze the right and left side of a Mitsubishi Pajero travelling ahead of her on the Duta-Ulu Klang Expressway (DUKE) last year.

Insurance executive Rosmaliza Mazalan, 42, said she saw the contact between the right-side of the Pajero and the yellow Myvi before the Pajero skidded to the left and was hit by the white Myvi.

“The Pajero spun several times before coming to a halt in the middle of the road,” she said during examination by deputy public prosecutor Suhaimi Ibrahim.

She was testifying in the trial of the two Myvi drivers, Mohammad Fizal Reza Jamauddin, 31, and Siti Noor Aini Mohd Said, 36, who are charged with reckless driving, resulting in the death of a family-of-three at KM6.2 of the DUKE from Ulu Klang heading to Jalan Duta, between 12.31am and 12.35am on May 2 last year.

Those killed in the crash were Fairuz Nizam Husain, 35, his wife Nova Safitri Azhari, 27, and their six-month-old baby Nur Firuza Annisa.

Rosmaliza, who was the ninth prosecution witness, was among the first eye-witnesses to arrive at the scene.

The woman told the court that she was at the wheel of her car returning home to Selayang Heights and was trailing behind a black Mitsubishi Pajero in the centre lane on the expressway.

As they were approaching a bend, she said, she saw, from the rear mirror, the headlights of several vehicles criss-crossing left and right, and a white Myvi was trailing behind her car.

“When the Myvi came close, I decided to give way and wanted to take the left lane, but the Myvi also wanted to go to the left. So, I remained in the centre lane and then saw a yellow Myvi overtake me in the right lane,” she added.

Soon after, Rosmaliza said she saw the yellow Myvi losing control and hitting the right side of the Pajero, which was ahead of her.

Following which, Rosmaliza said she slowed down and then pulled to a stop. She got out of her car after hearing someone saying that there was a baby in the middle of the road.

At that time too, she said, she saw a white Myvi stopped in the left lane, but did not see the yellow Myvi.

Rosmaliza said she approached the baby and found the child motionless, but left when other passers-by moved the baby to the side of the road and rang for an ambulance and police.

Questioned by Suhaimi whether she could identify the driver of the white Myvi, Rosmaliza said she could.

“The reason is I almost wanted to punch the driver (at the scene). First, because of the baby (Nur Firuza Annisa) and second, because the driver denied crashing into the Pajero,” she said.

Rosmaliza said the driver of the white Myvi was driving at high speed.

No problems. This case has been happened for almost 10 months. We are all hoping for a good closure on this case. Next court trial will be at end of this month. This will be last update for this week.

Hope will this will be a lesson for those always drive in dangerous manner on this road. Also baby car seat is essential for those kids whom can't be fasten with normal seat beat.

​A witness in the trial of two Perodua Myvi owners accused of reckless driving, which resulted in the death of three people, said she gave way to the car behind hers to avoid being hit.

Fairuz Nizam Husain, 35, his wife, Nova Safitri Azhari, 27, and their 6-month old daughter, Nur Firuza Annisa, who were travelling in a Mitsubishi Pajero 4WD, were killed in the crash.


Replying to deputy public prosecutor Suhaimi Ibrahim in the Kuala Lumpur Traffic Court today, Rosmaliza said a white Myvi was tailgating her car on the DUKE.


"The white Myvi was so close to my car that I gave way to avoid being hit," said the prosecution's ninth witness.


When asked what she meant when she said in her testimony yesterday that a yellow Myvi was being driven haphazardly at the time of the crash,  she explained that the car appeared to be out of control before it crashed into the Pajero.


Rosmaliza was testifying in the trial of Siti Noor Aini Mohd Said, 37, who was driving a yellow Myvi, and Mohammad Fizal Reza Jamauddin, 32, who was driving a white Myvi, at the time of the incident.


Earlier, under cross-examination by Fizal counsel, S. N Seelan, Rosmaliza said she was incensed at the driver of the white Myvi because he had refused to admit that he was speeding and tailgating her car.


"He also did not seem at all concerned that there were children, my children, in the car in front of him," she said.


Siti Noor Aini was represented by counsel Omar Bakhi Ahmad.


The case heard before magistrate Zilfinaz Abbas continues on March 30. – Bernama, March 4, 2016.

Tak akan Malaysian senang lupa...

This fatal accident since last year till now still under court case, still calling witness to testified. Never heard any new update since march 2016 till now when there should be one more hearing scheduled on june 2016.

all news portal didn't have any new update on this. Dont tell me these fmc gang is from red shirt group etc. Not even puteri unno member, the cable shouldn't be that strong.
