Hi guys, does anyone know what is considered a section 43 vs a regular RM300 saman?
I was involved in an accident with the motorcyclist, I was making a right turn (slowly with signal on) into a residential neighbourhood going across incoming traffic, the motorcyclist on the other side was going really fast and probably doesn't have his light on (not sure) and collided with my car. He is 18 year old delivering pizza for Dominoes. I didn't notice him until he was right in front of me. Neither did the passenger beside me.
However, the sarjan said even if his lights were off or if he was going really fast, its guaranteed my fault and will charge me with s43 if the victim suffers any sort of fracture (kaki patah). After a week, the sarjan calls me to inform me that the victim has made the report and indeed "kaki patah". Section 43 says nothing about how badly injured the other party is, but it seems to be the basis on which the sarjan wants to charge me.
I have engaged my insurance adjuster to verify the police and medical report of the victim. Should I lawyer up as well?
