Hi guys, my car just got hit from behind by a motorcyclist on MRR2 Sri Gombak near Batu Caves. The cyclist slipped and fell while I was stationary in a traffic jam.
He is ok at the scene and agree to settle with me after. So I left the scene and came home. Now people are advising me to make a report with my Dashcam footage to safeguard myself. So my question is should I make the report? And which police station should I report it to? Is it the one at Jalan Bandar?
Thanks!
EDIT: Just and update, the cyclist was hurt and he had to claim his insurance and a report has to be made. So I have already made the report and now waiting for the keputusan report. My next question would be is there anyway for me to prevent losing my car's NCD if the keputusan shows that I'm in the right since this involves a motorcycle? Thanks!

QUOTE(loui @ Sep 27 2020, 05:09 PM) NCD means No Claim Discount. Biker can make a claim even if you think he is as fault, it is up to the judge to decide During that process, insurance company will hire lawyer for you and incurred cost Even if judge dismiss the claim (which is less then 0.01%), the fact that insurance company spend money to defend you, cost is incurred So once the biker file a claim, your NCD is gone In the case if the keputusan shows that I am on the right and the biker got saman, any way that I can protect my NCD? Is it wise for me to inform my insurer with the keputusan so that they can deny the biker's claim? Thanks!

QUOTE(loui @ Sep 28 2020, 12:54 PM) They can deny due to the law Insurance company can only resist the claim Claimant will bring the case to court and let judge decide And you need to testify infront of judge to convince him that you are not at fault QUOTE(loyarKL @ Sep 28 2020, 01:50 PM) From my perspective as a personal injury lawyer, whatever the outcome of the investigation results the judge is still entitled to decide on the liability based on his findings, the investigation results will only aid in favour of one party if any, however rest assured your insurance will find their panel lawyers to defend against/resist any third party claim made by the biker. Thanks guys! Means I will need to inform my insurer accordingly after I get the keputusan. I have dashcam footage that I'm in standstill in a traffic jam and the bike crashed into the back of my car... hope its useful...

I have dashcam footage that I'm in standstill in a traffic jam and the bike crashed into the back of my car... hope its useful... A follow up to my case for sharing and advice is very much welcomed! So my insurer sent me a letter saying that the motorcyclist who hit my car from behind has appointed a legal firm to claim against my insurance. The worst thing is the sergeant said the case could not be closed as the motor tat hit me claimed there is another motorbike hit him first before hitting me, and no keputusan can be made until the third motor come forward to make a report. Called my insurance and they say that in this cases, usually they will end up paying 50% of the claims and i will lose my NCD for sure. Which is unfair but I can only blame it on bad luck
