 Resigning Part.2, Company don't let me go

So guys, further to my previous thread "Resigning at the very peak of a project"

Here are the updates after passing my letter to the HR on 10 March (passed to boss on 4th March)

I would just make it in pointers this time, here's my current situation:

1) Boss is still pestering me to stay back, which I still firmly say no, keep on promising increment and promotion, but not saying how much.
2) To finish up this massive job alone, I practically went to work everyday from 7 March till 15 March (Apart from 14th March), FORCED OT culture is really a nono, no pay, no claims, no meals, losing family time, and bonus amount that don't equate the extra mile
3) Coming end of this week, to meet with HR and partner to have a final persuasion.
4) Boss claim that my resignation notice is not approved yet, assume that one month notice, no matter what, my last day to report duty shall be 10 April right? I will still have to pay back a fine for breaking the bond, I hope that this fine is negotiable
5) Boss claim it is hard to find replacement so asking me to stay back rclxms.gif rclxms.gif
6) This company is really squeezing me dry, hate this and will definitely leave on 10th April as shown in the Appointment Letter, 1 month notice of termination.

There is no such thing as non approval of resignation notice right, as I am serving a notice and not seeking permission to resign right? My boss has yet to sign the letter, but my letter has been passed to HR with a follow up email, the 1 month countdown should have begun right?

Dude,you're working in a construction site is it? I've just started. Can understand a bit what you're going through. Just got home btw. And yep, no OT whatsoever.

Design office? Its part and parcel of a consultant's career. Been through those, 9am to 12-1am working life, one leg kick. Lucky I got senior who is good though. A bit better now I can sleep before midnight. After you get your license and have your own people, you will know that's one of the necessary path.

No such thing as approval of resignation notice. The day your boss acknowledges (i.e. sign and return to you) is the day you resigned, then count 1 month or whatever from that date.

She didnt want to sign my letter leh... Tak boleh ini macam right? Shouldn't the countdown start the moment i send my letter to HR?

Yes it should.
Keyword being should.
If push comes to shove, do you have any evidence that you delivered your letter to HR? Did they give you any dated acknowledgement?

After letting u go, they need to find a replacement for u...someone they can take advantage off & being squeezed.

Then that's fine. Just follow up using that email to HR and your boss and everyone using language that says look here guys i have resigned on XX date and my last day will therefore be YY date.

Having said that, if you don't want to burn bridges with your current boss you could consider following his proposed timeline for when your last day of service is.

If you really do not intend to stay any longer, demand for a package that you think that they will never fulfill.

At least if they do, you will feel much better with the promoted package to carry out your role.

1) if your boss is sincere, he should put the offer in writing instead of telling it to you verbally.

2) unfortunately, that's what u signed up for from the very beginning. Whether the company gives you OT or bonus is at the company's discretion.

3) if your dead set on leaving. Just tender and get acknowledgement from HR, if HR refuse to acknowledge write a letter to HR that they have receieved the letter but refused to acknowledge it.

4) I didn't know slave labour was in trend again. If your contract say 1 month notice to terminate that is the only contractual obligation you need to observe. Tell him at the end of the notice period, you will leave the company regardless.

Btw about your bond? Did you serve proper notice? How long are you bonded for? What is the terms of exit?

5) that's him problem. Alternatively, he can pay u more to convince you to stay.

6) is alright you boss doesn't sign or release you come the terminate date, even better if he set off or withhold your salary, just go to labour department.
