Investment S&P Agreement, who keep?

hi dear member,

May I know who will keep the orginal Sales and Purchase Agreement during property construction period?
A) Developer
B) Owner/Purchaser
C) Bank Lawyer
D) Bank

I take a loan with Bank Rakyat.

normally have 4 set of original copy & each parties get one set of S&P.

s&p normally all parties have the copies. but what important is your geran. if individual title, ori bank will keep it until loan finishes. specifically, the branch u applied the loan from.

anyway, for easy understanding, all important documents bank will hold it until settle the loan. normally 2nd year can get a copy of it if already got individual title

I believe its only 2 sets of Original - One for Seller (Developer) and One for Buyer

But if Buyer is taking a Loan, the Property will be charged and hence, the Bank will keep the SPA and Land Title until the Loan is fully discharged

After the Loan is fully discharged the Original SPA and Title will be released to the Buyer / Borrower

of cos u only got 1 as a buyer/owner .... the rest will go to other parties

but last time when i bought a property .. I need to sign 4 copies of S&P. Then I got one 'original' & one 'duplicate' to keep with me.

Yeah, I also signed 4-copies

Was told that

2 tag as Original

2 Tag as Duplicate


1 - Original - Developer

1 - Original - Buyer - but kept by Bank during Financing

1 - Copy - Buyer

1 - Copy SPA Lawyer

4 copies of the SPA in the following manner:-

1) Stamped original to be retained by the bank.

2) Stamped duplicate to be retained by the purchaser.

3) Stamped copy to be retained by the SPA solicitors.

4) Stamped copy to be retained by the developer.

Thought both Buyer and Seller should have their own Original Copy, esp for Court Action?

cheryee is right.

I just went to the S&P Lawyer and find out the same like what Cheryee told here.

There is only ONE original copy of S&P, and is now in the hand of bank (because I took bank loan)

Okay, my wrong, only 1 original copy

Always thought to sue you need original copy of Agreement so both buyer and seller must have original to sue.

Only one is ORIGINAL and others is DUPLICATE and COPY.

ORIGINAL is used as security document to bank if you take loan from bank.
