 [WTA] Low Cost Unit, Transfer from parents (as a gift)

Hi all sifus,

Seeking advise on behalf of my fren on low cost unit - transfer of ownership.

Her parents have a low cost flat at Selesa Jaya (Johor). As they are old and not wanting to make wills (due to whatsoever reasons la... i donno), they wish to transfer the low cost unit to her...

But she was told that at her income level, she cant own low cost unit...

So.. seeking advise form all sifus on what and how to go about this.


Info:

*Low cost flat @ selesa jaya (johor)
*freehold / with strata title
*housing loan cleared - no more owing bank
*her gross income is abt 4k/mth


i did some search on johor land office website la... it mentions that:

DOKUMEN-DOKUMEN YANG PERLU DISERTAKAN BERSAMA BORANG PERMOHONAN
1) Salinan hakmilik yang telah didaftarkan nama pemohon sebagai pemilik berdaftar.
2) Salinan kad pengenalan pemohon dan penerima.
3) Salinan surat kelahiran (sekiranya balasan kasih sayang dan Tanah Rizab Melayu).
4) Salinan surat persetujuan daripada Pejabat Setiausaha Kerajaan Bahagian Perumahan Johor (sekiranya pindahmilik tanah bagi kategori rumah kos rendah).
5) Surat persetujuan pemegang gadaian (sekiranya tanah masih dalam gadaian).
6) Keratan asal iklan surat khabar (3 kali dalam masa 3 bulan) sebagai bukti (sekiranya tanah lot bumiputra).
7) Perintah yang memberi kuasa untuk memindahmilik tanah (sekiranya pemohon dilantik oleh mahkamah).
8) Sijil Pendaftaran Syarikat, Borang 49, Borang 24, ‘Memorandum of Articles of Association , Resolusi Syarikat (sekiranya pindahmilik melibatkan sesebuah syarikat).
9) Sesalinan resit cukai tanah dan cukai harta bagi tahun semasa.


is it difficult to get consent form Pejabat Setiausaha Kerajaan Bahagian Perumahan Johor??

Easiest way: Ask your parent to sell off the low cost flat, cash out and park the money into your bank account.

what i meant is, is it possible for a person who earns RM4k p.m to receive a low cost unit (as a gift fr parents)?

no point of engaging a lawyer and later found out that it's not possible to do so...... sweat.gif sweat.gif

change name only. no need take loan, no need pay.
So doesn't relate to your salary?

Don't have to engage lawyer and find out last min it is not possible.
Can ask them before proceeding?

go to SUK & land office to ask.
no loan & freehold... she can do the transfer herself...
for 'kasih sayang', SUK maybe a bit OK to approve

Since purely ownership transfer without any monetary involve, it will be transfer under Love & Affection which the stamp duty is 50% discount
There will no loan involve as the property is paid off.
SPA (Sales and Purchase) only will be involve if there's monetary transaction example parents sell off the property to their children or third party which the stamp duty will be 100%.

salary is mentioned because she worry that cant get SUK consent... coz low-cost units are 'suppose' for lower income ppl to own one... not for those middle income ppl... cool.gif

no matter how, all this work require lawyer to execute it for you.
