I have question about fatwas in Malaysia. Has there been any cases of fatwas being revisited, revised, or dissolved in Malaysia.
*
I don't really know much, but one case I can remember is fatwa on ASB. As u know for ASB some states allow it, while other not allowed. However, there are some states who initially disallowed it. But later after series of deliberation, and with new information and facts, they revised earlier decision, and made it permissible.

QUOTE(WinkyJr @ Dec 23 2020, 11:17 AM)
recently read a thread about suicide in /k, make me wonder about the verse

“Allah tidak membebani seseorang melainkan sesuai dengan kesanggupannya.”
(Surah al Baqarah 2:286)

is suicide considered 'kesanggupan' here? or is it clearly an act against the verse, hence commit big sin?

Allah know the limit for each human and his creation and He knows whether a man can take it or not, so why he still uji those who can't take it and resort to suicide when life hit the wall? maybe give easy ujian perhaps?
*
I think kesanggupan refers to all form of tests in life. I like to believe that if we think the burden is so hard, it is because we haven't fully grasp the idea that we are capable of overcoming it. And that sooner or later it will pass, and we wil pass the test.

And even if we are not able to take the ujian, I like to believe it's god's way of preparing for a better rewards in hereafter. After all no good deeds is going to waste, especially if you stay patient.

For suicide, as human our logic may tells us that it is the solution. And why not, coz it will take everything away, all the pain. But again I like to the think this way.

We belong to Allah. Every thing we own, every piece and inch of our body is just a tool or medium that is given by God. And it is not within our right to damage or harm what does not belong to us.

Yes I know it is easier said than done, especially if you dont personally experience the anxiety... I can only hope that God will give strength to those facing such condition.

saya dah 5 tahun kerja dengan maybank. dah lama terfikir nak berhenti.

macam mana nak perangi riba kalau berperang dengan majikan pun tak mampu?

berat dosanya tu. allahu.
*
Sentiasa berusaha cari kerja lain.

That's good to know.

So that means that they buy before we buy?

As in, if I wanted to buy a car (car loan) with them, they will buy that car for me and then I will pay them without any down-payment made to the dealer?

Also, money we keep in the bank will not give interest?
*
It depends on what type of Islamic contract being used for that particular financing product....

For buying car usually hire purchase contract... Effectively the monthly installment you pay to bank is paying rental... For your usage of the car. When you finished paying installment, bank will transfer ownership of the car to you.

There is no such thing as interest when you keep money with Islamic banks, simply because contractually you are not lending your money to the bank. So when there's no lending and borrowing, there will be no interest.

Instead, any dividend Islamic banks gives you could be either
1) voluntary gift (without prior commitment) - if the underlying contract is wadiah

2) profit - if the underlying contract is sale

Apabila seseorang di antaramu memberikan pinjaman, lalu yang menerima pinjaman memberikan hadiah
kepadamu atau meminta kamu untuk menaiki kendaraannya, maka janganlah engkau menaikinya dan jangan
terima hadiahnya. Kecuali pemberian hadiah tersebut telah berlangsung antara kamu dan dia sebelum engkau
memberi dia pinjaman.” [HR Ibnu Majah, dinyatakan hasan oleh Imam Suyuti]

Keyword here is pinjaman... Or qard
Whereas the akad or contract for our saving account is not qard. It's wadiah, not the same as qard.

QUOTE(abu.shofwan @ Feb 2 2021, 11:38 PM)
Like they say, a rose by any other name is still a rose. There will come a time that khomr will be given (called) a different name so that it can be consumed by the people who are oblivious.

Point is... Whether or not it is qard or wadiah, we need to look at the essence of it, the fundamentals of the transaction.

In wadiah, you get back the item you give, not an equivalent/substitute. In qard, you can lend out your motorbike and the guy can return to you a similar/equivalent bike. In wadiah, it must be the same bike that is returned. In terms of money, it should be the same bank notes (same serial number).

Obviously, there are other related rules, but in this regard, to establish whether it is qard or wadiah, we can look at the object.

I quote below.

(note: I think "pen." at the end of the above quote is either the writer/penulis or translator/penerjemah. Who knows, not really familiar with these terminologies)
*
It is not the classical wadiah as in you keep your item with other person. It is wadiah yad damanah. This a contract introduced by scholars through their ijtihad. What does it mean?
-You intend to keep you money with the bank. This is wadiah part.
-At the same time you authorize bank to use your money, why? Because that's how banking system work, that's how the accounting, any money deposited will be put in pooled account.
-Due to the money being used, bank shall provide guarantee to return principal amount upon request (withdrawal)

What sheikh Utsaimin said is his ijtihad.... which one of so many other scholars ijtihad. You are free to follow which opinion you are comfortable with.

QUOTE(king99 @ Mar 28 2021, 07:17 PM)
Hi, I want to ask something regarding halal and haram in medicine. I am not a Muslim btw so want to get an insight on this. Correct me if I am wrong it any of my statement below.

I know if there is no choice in terms of medicine and it can save life , the medicine which contain haram ingredient (e.g. pork) is halal.

If there are two medicine (one halal and one haram) which have the same "power" , choose the halal one.

I was wondering what Islam say if this situation.

Let's say we have 2 medicine, medicine A got haram stuff, and medicine B is pure halal. But medicine A can cure in 1 month, but medicine B will cure only in 3 months. If you take medicine B you cannot return to work for extra 2 more months which will affect your income.

Can a Muslim take medicine A due to it being more effective than medicine B ?
*
For me, if you have the option between halal medicine and non-halal medicine. Always opt for halal.

Of course in Islam, there is cases where exception is given to existing ruling. But this is normally in extreme cases involving life and death.

Btw, how severe is the 3months without income will affect your friend? I think each person is different in term of, ability to absorb the impact, how much personal saving available... etc

I see, let's say if waiting for extra 2 months will cause the person to have difficulty in life (e.g no savings car will be towed if no pay since no work) it should be a good justification to take the "non-halal" medication right ?
*
As a muslim, practicing our religion (obeying Allah's order) is never meant to be easy, after all life in this world is a test. Every Muslim will face certain struggle, difficulties, hardship at different phases of life. That's the price we pay to attain the highest prize (paradise). As for your friend, the test he is facing is whether to take halal medication (instead of non-halal), and consequently suffers a certain degree of hardship in his financial.

In this case, he needs to make an honest assessment of his situation. First, will not getting salary for three months will give serious impact to his financial. If yes, how certain is he of this outcome? It must be at least with more than 50% probability... Based on his analysis. Only he can answer this.

Second, is there other way that can smoothen the impact of not getting income? Example, can he borrow from relatives, can he discuss with bank... Etc (just an examples). The point here is he must exhaust all means within his power to avoid taking non halal medication. It's like giving your best effort first, before deciding to go for non-halal. Again, he needs to answer this with full sincerity.

If there is no halal medication available, then it is more straight forward. But in this case, there is halal alternative. So to me, it is not right to jump straight to non-halal, before doing thorough self-assessment, and considering all possible solutions. What is important here is giving our best effort in practicing the religion and observing the halal way of life. That is what matters.

salam semua,

saya ingin bertanya,

salam guys,

nak tanya sikit, apa hukum guna barang syarikat untuk aktiviti lain, contoh laptop.

syarikat bagi laptop untuk kerja2 opis, tapi bila balik rumah (lepas abis opis hour 8-5), kita guna untuk urusan lain, contohnya google classroom, sosial media, browse internet, etc
*
Pendapat saya:

-guna utk aktiviti yg beretika
-tidak sampai menjejaskan prestasi laptop (tidak berlebihan)
-tidak dedahkan laptop kpd risiko spt kecurian, rosak dll. (Cth bagi org lain guna)

keep an open mind... but how come people make air yasin... but ive never seen people make air sirap, air coke, etc yasin...

and in that regard, for muslims who smoke, what about rokok yasin?

my efforts in asking this question to... whatsapp groups  have been met by scrutiny. the think im joking.. or making fun of religion... but i think its perplexing... cuz i dont think theres a "recipe" that says must use air kosong... what about osmosis, mineral, sink, air masak...air sungai.
*
It is a pure act of imitating the prophet which as a Muslim you will be rewarded. Just like other sunnah such as applying perfume etc.

Regarding air yasin, there is a hadith where sahabah was stung by a scorpion, so the prophet asked for some water with salt and he rub the water to the wound while reciting some surahs. So scholars concluded that any Qur'an verse (not specific to yasin) in general can be used for related purpose.

And as general rule when we imitate the act of the prophet we don't go beyond what he's doing...
