Apparently yes you can. New kinect games released do not have ap2.5 checks, so its safe for you to play those backup games. However if you update to the latest dashboard, you wont be able to play fable 3.

So while waiting for kinect, just try to finish up fable 3 so you wont be missing it when you updated the kinect dashboard ^^

So far the only problem faced by modded console is to bypass ap2.5. Atm kinect games has no ap2.5 checks. To answer your question, yes u can play kinect games by upgrading your xbox to the latest firmware which support kinnect
