Nope. If you do your homework, the update allows new games like Fable III to kick you into banned heaven, where this time the consequences aren't just not being able to sign into LIVE, but not being able to play newer games (this would most likely include Kinect games) offline too. I think you might still be able to play your older games offline, but no more new games for you until you buy a new Xbox 360.

So, as of now, Kinect + modded Xbox 360 = No go.

Hmmm, rayz85 is right. Apparently at least Kinect Sports and Dance Central don't have ap 2.5 checks. So technically one would be able to update to the new dash and play Kinect games on a modded console, but if they were ever to try to run Fable III or any other game with ap 2.5 checks, bye bye console. So if you know what you're doing, you'd be taking a calculated risk.
